HomeMy WebLinkAboutOrdinances Book 14, Page 719, No Ordinance NumberAN ORDINANCE AUTHORIZING THE SALE TO THE MARQUETTE CEMENT MANUFACTURING COMPANY, AN ILLINOIS CORPORATION, WITH PRINCIPAL OFFICES IN CHICAGO, ILLINOIS, OF CERTAIN PROPERTY ON MEYERS STREET OWNED BY THE CITY OF PADUCAH, SETTING FORTH THE TERMS AND CONDITIONS OF SUCH SALE, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DEED OF CONVEYANCE THERETO BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the sale to the Marquette Cement Manufacturing 719-. Company, an Illinois Corporation with principal offices in Chicago, Illinois, for the sum of $17,368.80, of certain property of the City on Meyers Street, and described hereinafter, be authorized under the terms and conditions hereinafter set out. SECTION 2. The description of the property mentioned in Section 1 hereof is as follows: Situated in the City of Paducah, County of McCracken and State of Kentucky, and beginning at a point in the northerly right-of-way line of Meyers Street,: said point being 28 feet at right angles to Meyers Street from the point where the center line of Clements Street intersects the center line of Meyers Street; thence in a southeasterly direction with the northerly line of Meyers Street 30 feet to a stake; thence at right angles and in a southwesterly direction 5.5 feet to a stake; thence at right angles and in a southeasterly direction and with the northerly line of Meyers Street 110 feet to a stake; thence at right angles and in a northeasterly direction 395 feet more or less to the low water mark in the Tennessee River; thance in a northwesterly direction or downstream with the meanders of said low water mark to a point in said low water mark where a line perpendicular with the northerly line of Meyers Street would intersect the beginning point; thence in a southwesterly direction on a line perpendic- ular to Meyers Street 420 feet more or less to the point of beginning. Also a perpetual easement for the construction, maintenance and operation of a railroad spur track over certain adjacent lands of the City described as follows: Beginning at a point on the North right of way line of Meyers Street, said beginning point being Easterly 140.00 feet, as measured along the center line of said Meyers Street and Northerly 24.5 feet as measured square to said center line, from the intersection of the center line of said Meyers Street with the center line of Clements Street; thence, northerly, square to the North right of way line of said Meyers Street, 15.00 feet; thence at an interior angle of 78' 411 24" and in an Easterly direction 76.49 feet to said North right of way line of Meyers Street; thence, with said North right of way line and in a Westerly direc- tion 75.00 feet to the point of beginning. Subject, however, to the following conditions and reservations 1. The building and the radio mast and flag pole situated upon the above described land are to remain the property of the City of Paducah, and the City shall have ninety (90) days from the payment of the purchase price in which to remove said building and mast. A perpetual easement is reserved over a strip of land fifteen (15) feet wide across the north end of the above described property, said strip extending from Meyers Street to the low water mark in the Tennessee River for the maintenance and operation of a storm sewer, and no use shall be made of such strip of land that will conflict or interfere with such purposes. 3. A perpetual easement is reserved over a strip of land fifty (50) feet in width running from the north boundary line of said land to the south boundary line thereof for the construction, operation and maintenance of flood protection works, including but not limited to a floodwall, and no use shall be made of such land that will conflict or interfere with such purposes; such strip being as described in a deed of record in Deed Book 390, page 221 in the McCracken County Court Clerk's office. 4. There is reserved for street and other public thoroughfare purposes only a strip of land 5.5 feet in width and 110 feet long off of the west side of the above described land and beginning 30 feet south of the north boundary line of said land and extending southwardly to the south boundary line thereof. 5. The sale of said land is made subject to (a) the easement or rights of the Chicago, St. Louis & New Orleans Railroad Company as set out in Deed Book 68, page 464 in the aforesaid Clerk's office, and (b) the easement retained by the United States of America of record in Deed Book 390, page 221 in the aforesaid Clerk's office. The City of Paducah acquired title to the above described land on November 4, 1957, from United States of America by a deed of record in aforesaid Deed Book 390, page 221 in the aforesaid Clerk's office. SECTION 3. Upon payment of the aforesaid purchase price of $17,36$.80, the Mayor and City Clerk are hereby authorized, on behalf of the City of Paducah, to execute to the Marquette Cement Manufacturing Company a deed of conveyance conveying to it the land described in Section 2 hereof, subject to the conditions and reservations recited herein; and said deed of conveyance shall contain no warranty of title and shall be subject to any state of facts that might be revealed by an accurate survey.
