HomeMy WebLinkAboutOrdinances Book 14, Page 704, No Ordinance NumberAN ORDINANCE ACCEPTING THE BID OF EMULSIFIED ASPHALT COMPANY FOR THE SALE TO THE CITY OF TYPE RS, ME, SS AND AE -200 EMULSIFIED ASPHALT REQUIRED BY THE CITY OF PADUCAH DURING THE YEAR 1962, AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE A CONTRACT FOR THE PURCHASE OF SAID MATERIALS, AND PRESCRIBING THE TERMS AND CONDITIONS UPON WHICH SAID PURCHASES SHALL BE MADE BE IT ORDAINED BY THE BOARD OF COIJ24ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the bid of Emulsified Asphalt Company for sale to the City of Paducah of types RS, MIS, SS and AE -200 emulsified asphalt required by the city during the year 1962 be accepted, and the City Manager is hereby authorized to enter into and execute a contract for the purchase, upon the order of the City, all of such asphalt to be used during the year 1962, said contract to contain the following terms, conditions and covenants: Orders are to be placed by collect telephone call to the Seller and delivery to be made by transport truck within twenty-four hours after order. All asphalt must meet Kentucky State Highway Specifications. The Seller shall furnish and install a 10,000 or 12,000 gallon storage tank at 6th and Campbell Streets, Paducah, Kentucky, where delivery is to be made at $0.1300 per gallon. Said contract shall also contain all terms, conditions and covenants contained in the resolution authorizing the advertisement for bids, which was adopted by the Board of Commissioners on March 6, 1962. A guarantee shall be provided against advance in the market price and a guarantee shall be provided for reduction in price in the event of a decrease in the market price, and the Seller shall post a performance bond in the amount of $2,500.00 guaranteeing specifications and delivery. The terms of payment shall be 2% discount within ten (10) days and net price as above in thirty (30) days. SECTION 2. This ordinance shall be introduced at a Regular Meeting of the Board of Commissioners and remain on file for at least one (1) week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
