HomeMy WebLinkAboutOrdinances Book 14, Page 7, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COIN11ISSION RESPECTING A CERTAIN PLAT OF SURVEY AND CERTIFICATE OF DEDICATION RELATING TO PROPERTY OF CHRISTINE ALLISTON LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF LOVELACEVILLE ROAD (LONE OAK ROAD) AND JACKSON STREET, AND APPROVING SUCH PLAT AND ACCEPTING THE DEDICATION THEREON WHEREAS Christine Alliston has heretofore submitted to the Paducah Planning and Zoning Commission a plat of property located on the northeast corner of the intersection of Lovelaceville Road (Lone Oak Road) and Jackson Street, and 101HEREAS said plat conforms to the requirements hereto- fore prescribed by the Engineering Department of the City of Paducah and the Kentucky State Highway Department, and 6MREAS said plat contains a certificate of dedication of the public rights-of-way shown thereon, which certificate the said Christine Alliston has indicated she will execute and ac- knowledge in due course, and WHEREAS said Paducah Planning and Zoning Commission has approved said plat and has recommended to this body the adoption of an ordinance giving further approval thereto and accepting the dedication of the public rights-of-way shown thereon, to the extent that such rights-of-way have not previously been accepted, which action is embodied in a final report in the form of a resolution adopted on January 21, 1959, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COY1Mtdi SSION ON THE PLAT OF SURVEY AND CERTIFICATE OF DEDICATION RE- LATING TO PROPERTY OF CHRISTINE ALLSITON LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF LOVELACEVILLE ROAD (LONE OAK ROAD) AND JACKSON STREET", NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMI SSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the aforesaid resolution adopted by the Paducah Planning and Zoning Commission on January 21, 1959, shall be, and it is hereby, approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the aforesaid plat, which was prepared by the engineering firm of Hollis and Griggs, Inc., bearing the date January, 1959, and entitled "Plat of Survey of the Christine Alliston property" shall be, and it is hereby, approved, and the dedication of the public rights-of=way shown thereon, to the extent that such rights-of-way have not previously been accepted, shall be, and it is hereby, accepted in behalf of the City of Paducah, Kentucky, but such acceptance shall not constitute an undertaking on the part of this body or of the City of Paducah, Kentucky, for the improving or maintenance of said newly dedicated portions of said rights-of-way, that being a matter for separate consideration and action. SECTION 3. That if any section, paragraph or provision of this Ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, para- graph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this Ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 4. This Ordinance shall be in full force and effect from and after the date on which the aforesaid plat is lodged for record in the office of the Clerk of the McCracken County Court with the certificate of dedication thereon properly executed and acknowledged by the said Christine Alliston. •ayor Passed by the Board of Commissioners January 27, 1959 Recorded by Sarah Thurman, City Clerk, January 27, 1959.
