HomeMy WebLinkAboutOrdinances Book 14, Page 635, No Ordinance Number7 635 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, A CERTAIN BOUNDARY LINE AGREEMENT BETWEEN SAID CITY AND EISIETT L. BEYER AND WIFE, MARY BEYER. WHEREAS the City of Paducah, Kentucky owns certain property in said City known as Paxton Park Golf Course, which property adjoins certain property of Emmett L. Beyer, and WHEREAS it appears that the exact location of such boundary line is more or less uncertain, and WHEREAS it is the desire of the Board of Commissioners of said City to have such boundary line definitely established. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF CONRIIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk are hereby authorized and empowered to execute, on behalf of the City of Paducah, Kentucky, a boundary line agreement between said City and Emmett L. Beyer and wife, Mary Beyer, in words and figures as follows, to -wit: "THIS BOUNDARY LINE AGREEMENT, made and entered into on this the _ day of ,1961, by and between CITY OF PADUCAH, KENTUCKY, party of the first part, and E114ETT L. BEYER and wife, MARY BEYER, of the City of Paducah, Kentucky, parties of the second part; WI TATESSETH: "THAT WHEREAS, the party of the first part owns certain land in Paducah, Kentucky known as Paxton Park Golf Course, and "WHEREAS, Emmett L. Beyer, one of the parties of the second part, j owns certain land adjacent thereto, and i "WHEREAS, it appears the exact location of such boundary line is more or less uncertain, and "WHEREAS, such boundary line has recently been established by a survey made for a proposed development of Nursing Homes, Inc, and the plat of said survey known as ?Plat of Survey for Resubdivision of Emmett Beyer Property Developed by Nursing Homes, Inc.?, which plat was recorded on November 17, 1961 in Plat Book ?G', page 61 in the McCracken County Court Clerk's Office, and "WHEREAS, said boundary line as shown on said plat is satisfactory to all parties hereto. "NOW THEREFORE, in consideration of the premises and in consideration of the establishment of a boundary line between the land of the party of the first part, known as Paxton Park Golf Course, and the land of Emmett L. Beyer, one of the parties 636 of the second part, and other good and valuable consideration, the receipt of all of which is hereby acknowledged, it is hereby agreed that the boundary line between the land of the City of Paducah, Kentucky, known as Paxton Park Golf Course and the adjoining land of Emmett L. Beyer is as shown upon the aforesaid plat of the resubdivision of the Emmett Beyer property of record in Plat Book tGt, page 61 in the aforesaid Clerkts office. "The execution of this instrument on behalf of the City of Paducah, Kentucky, was authorized by an ordinance adopted by the Board of Commissioners on said City on the _ day of , 1961. "IN TESTIMONY WHEREOF, the party of the first part, by and through ITS Mayor and City Clerk, and the parties of the second part have here- unto set their hands on this the day and year first above written. Cherry, Mayor of the City of Paducah, Kentucky, to be his act and deed as such and to be the act and deed of said city, and also was at the same time and place acknowledged before me by Emmett L. Beyer and wife, Mary Beyer, for the therein mentioned. 1961. My Commission will expire on the day of Given under my hhnd and seal on this the day of Notary Public, -McCracken County, Ky. SECTION 2.
