HomeMy WebLinkAboutOrdinances Book 14, Page 611, No Ordinance Number611.. lam` AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING COM[t-1ISSION RESPECTING THE SUBDIVISION OF SECTION II OF BELLEMEADE SUBDIVISION, ABUTTING ON MILLER DRIVE AND OLD ORCHARD ROAD, APPROVING THE PLAT OF SAID SUBDIVISION, AND SUBDIVIDING SAID PROPERTY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a Resolution adopted by the Paducah -McCracken County Planning Commission on September 20, 1961 entitled "A RESOLUTION CONSTITUTING TIE FINAL REPORT OF THE PADUCAH-MCCRACMN COUNTY PLANNING COWISSION REGARDING THE PROPOSED SUBDIVISION OF SECTION II OF i BELLEI11EADE SUBDIVISION, ABUTTING ON MILLER DRIVE AND OLD ORCHARD ROAD" shall be, and it is hereby, approved as the final report of II said Commission respecting the matters therein set forth. SECTION 2. That the subdivision of the property of the Max E. j Miller Estate known as Section II of the Bellemeade Subdivision, which abuts on Miller Drive and Old Orchard Road (formerly Applewood Way), shall be, and it is hereby, approved as shown on said plat, which plat bears the legend "PLAT OF BELLEMEADE SECTION II", and is dated July, 1961, It having been prepared by Engineer Elmer Y. Hollis, whose certificate appears thereon. SECTION 3. That the dedication of the public rights-of-way and easements shown on said plat shall be, and it is hereby, accepted, but such acceptance shall not constitute an undertaking on the part of the City of Paducah for the improving or maintenance of said rights-of-way and easements, that being a matter for separate consideration and action. SECTION 4. That if any section, paragraph or provisions of this ordinance shall be found to be inoperative, ineffective or invalid for j any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable �I from all other sections, paragraphs and provisions. SECTIObI 5. This ordinance shall be in full force and effect from iI and after its adoption.
