BAILEY (FORP•7,RLY FRED UIILES), LOCATED ON THE NORTH EAST CORNER OF TIIE INTERSECTION OF NcGUIRE AVENUE AND TRIMBLE STREET, APPROVING THE PLAT OF SAID SUBDIVISION, AND SUBDIVIDING SAID PROPERTY BE IT ORDAINED BY THE BOARD OF COI-il•IISSIONERS OF THE CITY OF PADUCAH, IENTUCKY: SECTIOPI 1. That a Resolution adopted by the Paducah-I-icCracken County Planning Commission on September 6, 1961, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH-I.TcCRACI{EII COUNTY PLANNING COU11IISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF FRED !-ALES, LOCATED ON THE NORTH EAST CORNER OF THE INTERSECTION OF I!cGU= AVEIIIUE AILD TRIP•IBLE STREET", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the subdivision of the property of Ivan E. Bailey (formerly Fred Miles) located on the north east corner of the intersection of McGuire Avenue and Trimble Street shall be, and it is hereby, approved as shorn on the plat referred to in the aforesaid Resolution, which said plat is entitled "RESUBDIVISION OF A PORTION OF THE PALES ADDITION", and is dated August 28, 1961, it having been prepared by Engineer Elmer Y. Hollis, whose certificate appears thereon, and said property is hereby declared to be subdivided as shorn on said plat. SECTION 3. That the dedication of the public rights-of=ray shown on said plat shall be, and it is hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or of the City of Paducah, Kentucky, for the improving or maintenance of said rights-of-way, that being a matter for separate consideration and action. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, II paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SEC^1ION 5.
