AN ORDINANCE GRANTING AN EASEMENT FOR THE LAYING OF WATER
MAINS IPI CERTAIN LAND IN KOLB PARK TO THE COM42SSIONERS OF WATER
WORKS, FOR THE USE AND BENEFIT OF THE CITY OF PADUCAH, IEHTUCKY;
DESCRIBING THE LAND TO BE INCLUDED IN SAID EASEMENT; AND PRESCRIBING
THE TERMS AND CONDITIOAiS OF SAID EASEMENT
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1, That there is hereby granted to the Commissioners
of Plater Works, for the use and benefit of 'the City of Paducah,
Kentucky, an Easement for the purpose of laying a water main or mains
in certain land in Kolb Park in the City of Paducah; the portion
upon which the Easement is granted being described as follows:
A strip of ground 10 feet in width 5 feet on
either side of the center line described below:
Beginning at a point on the east side of Sixth Street
407.73 feet north of the north east corner of Sixth
Street and Broad Street; thence at an angle to the
lest of $$ degrees 23 minutes, a distance of 9,1$
feet; thence at a deflection angle to the right of
46 degrees 20 minutes a distance of 47.90 feet;
thence at a deflection angle to the left of 45 degrees
37 minutes a distance of 180 feet more or less to a
public alley.
The conditions of the herein granted Easement are that the
Commissioners of Water Works will exercise care and caution for the
protection of persons and property in the construction and laying
of any water main or mains, and after any construction or repair work
should be done, said Commissioners will cause the surface of the land
described herein to be replaced in its former condition.
SECTION 2, This ordinance shall be introduced at a regular
meeting of the Board of Commissioners of the City of Paducah, Kentucky
and remain on file for at least one (1) week for public inspection
in the completed form in which it shall be put upon its final passage,
but it being necessary for the public health and safety of the City
that such aforesaid water main or mains be installed as soon as
possible, an emergency is hereby declared to exist and this ordinance
slall be in full force and effect from and after its adoption.
