FARRELL AND CHARLES F. FARRELL, DOING BUSINESS AS RELIABLE ADVERTISING COMPAINIY, FOR THE PLACING OF ADVERTISING BENCHES ON THE PUBLIC THOROUGHFARES OF THE CITY OF PADUCAH, AND PROVIDING TERMS AND CONDITIOITS OF SUCH CONTRACT BE IT ORDAINED BY THE BOARD OF COIrI SSIONERS OF THE CITTY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor be, and he is -hereby, authorized to execute, on behalf of the City of Paducah, Kentucky, a contract between the City and 19illiam W. Farrell and Charles F. Farrell, doing business as Reliable Advertising Company, which contract is in words and figures as follows, to -wit: "THIS CONTRACT made and entered into on this the day of , 1960, by and between the CITY OF PADUCAH, KEENTUCKY, party of the first part, hereinafter referred to as the 'City', and 1,11illiam 1. Farrell and Charles F. Farrell, doing business as Reliable Advertising Company, hereinafter referred to as the 'Company'. :l I T N E S S E T H : "THAT the City hereby grants permission to the Company to place advertising benches upon the public ways in the City for the accommodation of persons waiting for bus transportation and other transportation, subject to the following terms and conditiond: "The Company shall furnish and provide the City with indemnifying insurance protecting the City and persons from all liability caused by the placing of such benches in the followinr,- amounts: ,100,000.00 for personal injury or death to any one person 200,000.00 for personal injury or death to more than one person resulting from the same accident, and ;110,000.00 for damage to property in any one accident, including property owned by the City. "All benches installed by the Company shall be of good quality material, have cement ends with wooden seats and 'backs and not over seven (7) feet in length. The Company will provide proper maintenance of all benches for any damages or unsightly conditions which may occur. All adve-rtisinL appearing on the beaches shall be of an attractive nature and shall not include cords which might cause traffic confusion. 309 "No benches shall be placed by the Company in any portion of the City in violation of zoning ordinances. "The Company agrees to.promptly remove any bench or benches from any location upon the adoption by the Board of Commissioners of a motion directing such removal, and in the event of failure of the Company to remove same within ten (10) days after notification, the City shall have the right to cause their removal. "The Company agrees to pay the City One Dollar (i1.00) per bench for all benches installed during 1960, and Two Dollars (;2.00) per bench per year thereafter, and such payments are to be made within five (5) days after such installation, and on or before January 15th of each year for all existing benches. "Before installing any bench or benches, the Company will furnish the City Manager with a list of the exact locations where such benches shall be installed. "The term of this contract shall be for a term of five (5) years from the herein date unless sooner cancelled by operation of law or by the adoption of an ordinance by the Board of Commissioners of the city ordering such cancellation.
