CLYNCR AND HIS 1.1IFE, EDITH F. CLYITER, FOR PERR1ISSION TO CONNECT TO TRIC SEVER SYSTERI OF THE CITY, AND PRE- SCRIBING THE TERMS, COVENANTS ARID CONDITIORIS OF SUCH CONTRACT BE IT RESOLVED BY THE BOARD OF C01,UVISSIONERS OF TM CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized to enter into and execute, on behalf of the City of Paducah, Kentucky, a contract between the City and Kenneth H. Clymer and his wife, Edith F. Clymer, granting permission to connect to the sewer system of the City, to be in words and figures as follows: "TI -LIS CONTRACT ARID AGREEI•ENT made and entered into on this the day of June, 1960, by and between KENNETH H. CLY1'•','R AND :1IFE, EDITH F. CLY1,1ER, parties of the first part, and the CITY OF PADUCAH, IENTUCKY, party of the second part; 11ITNES3ETH: "THAT 611HEREAS, the parties of the first pare are the owners of certain land situated and being in the County of I•IcCracken and State of Kentucky, and described as follows: "Beginning at a stone on the north side of Buckner Lane, which stone is S. 5$017' wrest 531.90 feet from a stone at the northwest corner of the intersection of Valley Road with Buchner Lane; thence north 30 degrees 53 minutes west 303.90 feet to an iron pipe in the east line of Taller; thence north 30 degrees, 56 minutes west 146.11 feet to an iron pipe in the east line of !Taller; thence in an easterly direction at an interior angle of 90 degrees, 47 minutes 100.24 feet to an iron pipe; thencein a southerly direction with an angle of A9 degrees and 10 minutes 450 feet to an iron pipe in the north line of Buckner Lane; thence with the north line of Buckner Lane 100 feet to the point of beginning. Being the same property conveyed to Kenneth H. Clymer and wife, Edith F. Clymer, by Loren M. Jones and wife, Nell W. Jones, by deed dated February 4 1960 and of record in Deed Book 412, page 629, McCracken County Court Clerk's office. "AND IIHEREAS, parties of the first part are constructing a residence on said land and desire to obtain permission to connect to a city sanitary sewer situated in Buckner Lane within the city limits. 290 "NOW for and in consideration of the following terms, covenants and conditions, the parties of the first part are her( granted permission to connect 'to said sewer, which terms, coven, and conditions are as follows: r11. After such connection is made, the parties of the first part and their heirs and assigns will nay an annual rental to the party of the second part in the amount of Fifty Dollars ()50.00) per year, payable in advance. Party of the second part acknowledged payment of parties of the first part in the sum of Five Hundred Fifty L no/100 Dollars (.;550.00) for the connection fee as charged to other property oi•mers for connection to said sewer. 112. The parties of the first part bind themselves, their heirs and assigns that they will not object to any proceedings to annex the above described land to the City of Paducah. "3. In the event such land is annexed by the City the aforesaid annual rental charge of Fifty Dollard (•:!50.00) per year will be discontinued at the expiration of the then current rental period, and parties of the first part and their heirs and assigns ti-n_ll then pay the monthly sewer service charge as paid by other property oimers tr_thin the city. 114. Upon violation of any of the herein covenants by parties of the first part or their heirs or assigns, the party of the second part shall have the right to withdraw and cancel the privileges granted herein by giving ninety (90) days orritten notice to said parties of the first part or their heirs or assigns whichever may be the owners of the land above described at that time. Cherry, Mayor of the City of Paducah, I{entucky, to be his act and deed as such and to be the act and deed of said City for the purposes therein mentioned, and all of which was done in due form of lain.
