RUCKER, FOR PERMISSION TO CONNECT TO THE SEWER SYSTEM OF THE CITY, AND PRESCRIBING THE TERMS, COVENANTS AND CONDITIONS OF SUCH CONTRACT BE IT RESOLVED BY THE BOARD OF CO2-17ESSIOIdERS OF THE CITY OF PADUCAH, IENTUCICY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized to enter into and execute, on behalf of the City of Paducah, Kentucky, a contract between the City and Jack Rucker and wife, Edna E. Rucker, granting permission to connect to the sewer system of the City, to be in words and figures as follows: "THIS CONTRACT AND AGREEMENT made and entered into on this the day of June, 1960, by and between JACK RUCICER and wife, EDNA E. RUCKER, parties of the first part, and the CITY OF PADUCAH, KENTUCKY, party of the second part; 9 I T N E S S E T H : '}THAT I'IFEREAS, the parties of the first part are the owners of certain land situated and being in the County of i•icCracken and State of Kentucky, and described as follows: Beginning at a stone on the north side of Buckner Lane at the corner of Mrs, Lynn Boyd (now Gifford), thence southwest alomg the north side of Buckner Lane One Hundred (100) feet to a stake, corner of F. E. Golightly; thence northwest along the line of Golightly Three Hundred Six (306) feet to a stake in Golightlyts north line; thence along Golightlyts line One Hundred (100) feet to a stake and the line of said Gifford and six (6) feet north or northwest of an axle marker; thence in a southeasterly direction along the line of Gifford to a stone in Buckner Lane the place of beginning. Being the same land conveyed to Jack Rucker, one of the parties of the first part herein, by Kenneth Mitchell and wife, Umeeka Mitchell, by deed dated April 9, 1960, and of record in Deed Book 414, page 305, in the McCracken County Court Clerkts office. "AND 1r1HEREAS, parties of the first part are constructing a residence on said land and desire to obtain permission to connect to a city sanitary sewer situated in Buckner Lane within the city limits. 285 "NOW for and in consideration of the following terms, covenants and conditions, the parties of the first part are hereby granted permission to connect to said sewer, which terms, covenants and conditions are as follows: After such connection is made, the parties of the first part and their heirs and assigns will pay an annual rental to the party of the second part in the amount of Fifty Dollars (.';50.00) per year, payable in advance. Party of the second part acknowledges payment of parties of the first part in the sum of Five Hundred Fifty w no/100 Dollars(p550.00) for the connection fee as charged to other property owners for connection to said sewer. 112. The parties of the first part bind themselves, their heirs and assigns that they will not object to any proceedings to annex the above described land to the City of Paducah. 113. In the event such land is annexed by the City the aforesaid annual rental charge of Fifty Dollars :(•;?50.00) per year will be discontinued at the expiration of the then current rental period, and parties of the first part and their heirs and assigns will then pay the monthly sewer service charge as paid by other property owners within the city. "4. Upon violation of any of the herein covenants by parties of the first part or their heirs or assigns, the party of the second part shall have the right to withdraw and cancel the privileges granted herein by giving ninety (90) days written notice to said parties of the first part or their heirs or assigns, whichever may be the owners of the land above described at that time. Rucker, to be their separate act and deed for the purposes therein mentioned, and was also acknowledged before me at the same time and place by Robert C.
