HomeMy WebLinkAboutOrdinances Book 14, Page 214, No Resolution Number214 j t •i •�a 7 A RESOLUTION SETTING OUT THE NEED FOR THE CREATION OF AN AGENCY FOR THE EXERCISE OF SUCH POWERS, FUNCTIONS, AND DUTIES GRANTED BY CHAPTER 99 OF THE KENTUCKY REVISED STATUTES AND AUTHORIZING THE CREATION OF SUCH AN AGENCY HEREIN WHEREAS the Board of Commissioners of the City of Paducah, Kentucky, finds and declares the following: (a) That there exists in the said City of Paducah certain areas which are blighted and certain areas known as slum areas according to the definition of such areas as found ih Chapter 99 of the Kentucky Revised Statutes. (b) That there is a need in the City of Paducah for the exercise of powers, functions, and duties conferred by Kentucky Revised Statutes, Sections 99.330 to 99.510. (c) That the exerdise of such powers, functions, and duties by an agency created and established pursuant to the aforementioned statutes would be more efficient and in the best public interest rather than the exercise of such powers, functions, and duties by the city itself or by the Housing Commission. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Board of Commissioners of the City of Paducah hereby with the passage of this resolution creates an agency as authorized by KRS 99.350. SECTION 2. Said agency shall be named the Urban Renewal and Community Development Agency. SECTION 3, Said agency as herein created shall have all of the powers, functions, and duties but only those powers, functions, and duties authorized by KRS 99.330 to 99.510. SECTION 4. The agency herein created shall also be known as the Slum clearance and Development Agency of the City of Paducah. SECTION 5. Upon adoption of this resolution and pursuant to KRS 99.350, the Mayor shall appiint members of said agency with the approval of the majority of the Board of Commissioners. The agency shall consist of five resident electors 6f the City of Paducah as members. 215 Three of the members who are first appointed shall be designated to serve for terms one, two and three years respectively, and the re- maining two of such members shall be designated to serve for terms of four years each, from the date of thbir appointment. Thereafter members shall be appointed as aforesaid for a term of office of four years, except that all vacancies occurring during a term shall be filled for the unexpired term. A member shall hold office until his successor has been appointed and qualified. SECTION 6. Each section, paragraph, or provision of this 4 resolution is hereby declared to be separate from every other section, paragraph or provision herein and should any section, paragraph, or provision hereof be held invalid at any time it shall have no effect upon the validity of every other remaining section, paragraph or provision hereof. SECTION 7. This resolution shall be in full force and effect from and after its adoption.
