HomeMy WebLinkAboutOrdinances Book 14, Page 155, No Ordinance Number155 t_, AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COMi4ISSION RESPECTING THE SUBDIVISION OF PROPERTY OF JULIETTE KENNEDY MILLER, ,WHICH IS LOCATED ON BOTH SIDES OF IENNEDY ROAD BETWEEN THE LONE OAK ROAD AND BLANDVILLE ROAD, APPROVING THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY BE IT ORDAINED BY THE BOARD OF COI-uAISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a Resolution adopted by the Paducah Planning and Zoning Commission on September 16, 1969 entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COA'24ISSION ON THE PROPOSED SUBDIVISI OF PROPERTY OF JULIETTE KENNEDY PULLER, WHICH IS:7LOCATED ON BOTH SIDES OF KENNEDY ROBD BETIEEN LONE OAK ROAD AND BLANDVILLE ROAD" be approved as the report of said Commission respecting the matters therein set forth. SECTION 2. That the subdivision of -certain property of Juliette Kenne Miller (Max E. Miller Estate) which is located on both sides of Kennedy Road between Lone Oak Road and Blandville Road, as shown on the plat prepared by Engineer Elmer Y. Hollis, entitled "Plat of Bellemeade", be, and it is hereby, approved, and said property is hereby declared to be subdivided as shown on said plat, it being understood and stiuplated that said plat shall be regarded as, and is, final with respect to all public rights-of-way shown thereon, and with respect to all utility easements shown thereof, and with respect to all o Block A, Lots 1 through 6 in Block B, all of Block C, Lots 1 through 8 in Block D and Lots 1 and 2 in Block G, and that said plat shall be regarded as, and is, tentative with respect to the balance of Block B, the balance of Block D, all of Block E, all of Block F, the balance of Block G, and all of Block H. SECTION 3. That the dedication of the public rights -of :way and utility easements shown on said plat be, and it is hereby, accepted, but such acceptance shall not constitute an undertaking on the part of the City of Paducah or of this Board to improve or to maintain such rights-of-way or easements, that being a matter for separate consideration and action. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective of invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being t1: purpose and intent of this ordinance to make each and every section,paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be in full force and effect from and after the date of which said plat is lodged for record in the office of the Clerk pf IdcCracken County Court.
