HomeMy WebLinkAboutOrdinances Book 13, Page 989, No Resolution Number9$9 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CERTAIN RELEASE OF ALL CLAIMS AND DEMANDS BETWEEN THE CITY OF PADUCAH, KENTUCKY, AGAINST ROGER F. CHRISTIE AND THE PADUCAH BANK AND SETTING FORTH SUCH RELEASE IN WORDS AND FIGURES BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute a release of all claims and demands between the City of Paducah, Kentucky, against Roger F. Christie and The Paducah Bank, which release is in words and figures as follows: "RELEASE OF ALL CLAIMS AND DEMANDS BETWEEN THE CITY OF PADUCAH,: KENTUCKY, AGAINST ROGER F. CHRISTIE AND THE PADUCAH BANK "KNOW ALL MEN BY THESE PRESENTS that The City of Paducah for the sole consideration of SIXTY FIVE HUNDRED (?6500.00) DOLLARS RECEIVED by the City of Paducah to its full satisfaction, said payment being made by M. 0. DeJarnatt, Trustee, and said payment being made by check number Thirty -One (31) of M. 0. DeJarnatt Trustee Account for Roger F. Christie, "AND said City of Paducah by and through its City Manager does now release and forever discharge the said Roger F. Christie, his executors and administrators from all debts, claims, demands, actions and causes of actions, whatsoever, from the beginning of the world to the date of this release by virtue of the City having placed improvements consisting of sewers and streets, which im- provements were beneficial to the laid Roger F. Christie and said improvements being on Harrison Street between 21st and 25th Streets, and all in accordance with prior approval and agreement between the City of Paducah by its Board of Commissioners and Roger F. Christie, individually, and said release applies in like manner to the Paducah Bank, Paducah, Kentucky, by virtue of its guaranty of the payment to The City of Paducah of the sum of Sixty -Five Hundred ($6500.00) Dollars for which Roger F. Christie was obligated to pay to said City upon completion of said work. "It being the intention of this release to forever dis- charge and relieve the said Roger F. Christie and The Paducah Bank from any further liability whatsoever in connection with the improvements and the construction of the sewers, streets and any other improvements on Harrison Street between 21st and 25th Streets, Paducah, Kentucky. It being acknowledged that 990 both Roger F. Christie and The Paducah Bank have performed all their obligations to The City of Paducah by the payment of the Sixty -Five Hundred (Q'j6500.00) Dollars as set out herein. In Witness whereof The City of Paducah has set its hand by and through its City Manager at Paducah, Kentucky, this December 23, 1958.
