HomeMy WebLinkAboutOrdinances Book 13, Page 893, No Ordinance NumberAN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES FOR THE USE OF AND SERVICES RENDERED BY THE MUNICIPAL SEWERAGE SYSTEM OF THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING FOR THE COLLECTION AND ENFORCEMENT OF SUCH RATES AND CHARGES WHEREAS at a general election held in the City of Paducah, Kentucky on November 2, 1954, a bond issue in the amount of $1,280,000.00 for the construction of a sewage disposal plant, including but not limited to a treatment plant, pumping stations and ihtercepting sewers was approved by the voters of said city, and WHEREAS, such bonds have been issued and sold and such plant and associated equipment has been constructed and is now in operation, and WHEREAS, there is a need for revenue to maintain and operate said plant and to maintain sewers, intercepting sewers leading thereto and therefrom and the construction and maintenance of other sewers necessary for use in connection with said plant. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That there is hereby established a schedule of rates and charges hereinafter set out for the use of and services rendered by the municipal sewer system of the City of Paducah, Kentucky, which shall be paid by the owner or occupant of each and every lot, parcel of land, building or premises in the City dis- charging sewage, water or other liquid waste into said sewer system of the City. SECTION 2. That the rates and charges as provided in Section 1 shall be in two classes as follows: CLASS I The rate for all residences and apartments having not more than four living units shall be a flat rate of $1.00 per month. CLASS II The rates for all other buildings including commercial and industrial establishments shall be set individually and based on (a) The average monthly consumption of water in gallons of the preceding year, and (b) Based further on the amount of said water used which is actually discharged into the sewer system of the City. The monthly rates of such Class II buildings shall be as follows: 0 to 10,000 gallons $1.00 10,000 to 100,000 " 3.50 100,000 to 400,000 't 7.50 400,000 to 1,000,000 if 13.00 1,000,000 to 5,000,000 it 20.00 5,000,000 to 10,000,000 it 28.50 10,000,000 to 20,000,000 it 38.50 20,000,000 or over it 50.00 SECTION 3. Then more than 25% of the water used by the aforesaid Class II establishments does not regularly flow into the sewer system of the 894 City, the excess over and above 25% shall be excluded from the calculations of the rates and charges. The burden of proof as to such amount of water no regularly flowing into the sewer system shall be upon the user, and the City Manager, or any city employee designated by him, upon information he believe to be correct and proper, shall have the authority to make a proper adjust- ment of such charges. SECTION 4. The herein charges for the use of and services rendered by the municipal sewer system of the City of Paducah, Kentucky shall be billed monthly as a separate item on the water bill sent out monthly by the muni- cipally owned Paducah Water Works, and said charge so billed shall be payable monthly at the office of the said Paducah Water Works in the same manner ands within the same time as required for payment of charges for water service. When any bill for water service and sewer service charge remains unpaid and becomes delinquent and the water service to the delinquent premises has been discontinued, such water service shall not be restored or reinstated until the entire charge for both water and sewer service is paid in full, including i any penalty for non-payment of water service. i The rates provided for and prescribed herein are applicable to all users) within the city limits who are now discharging sewage, water or other liquid waste into the sewer system of the City, and shall apply to all future users. Any user paying a charge provided for herein who is not discharging sewage, water or other liquid waste into the sewer system of the City shall, upon proper showing of same, be refunded by the City for all sums so paid and sha 1 be excluded from future billings and collections until such time as he may b subject to the charges provided for herein, Refunds will also be made by thi City to any user who has been charged and paid an amount in excess of a corr�ct rate. The rates and charges to be paid by Class II users making original connec- tions to the sewer system shall be estimated and fixed by the City Manager, or any city employee designated by him, until such time as an average monthly consumption in gallons of water can be ascertained, and refunds will be made 1 by the city to such users of all amounts paid in excess of the correct rate.j SECTION 5. The sewer usage rates set out herein shall take effect on iJ' July 1, 1958, and charges therefor shall be included on all bills rendered on and after said date by the aforesaid Paducah Water Works., SECTION 6. The Paducah Water Works shall render a monthly accounting and payment to the Treasurer of the City of Paducah on all moneys collected by it under the terms of this ordinance and shall be paid compensation for its services in an amount to be determined by a separate ordinance or resolution adopted by the Board of Commissioners of the City of Paducah, Ke: 895 SECTION 7. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 8. This ordinance shall be in full force and effect from and after its adoption.
