CORPORATION OF EVANSVILLE, INDIARTA, FOR THE PLACING OF WASTE RECEPTACLES UPON THE PUBLIC STREETS OF THE CITY OF PADUCAH; AND PROVIDING FOR THE TERI.IS AND CONDITIONS OF SUCH CONTRACT BE IT ORDAINED BY TIIE BOARD OF CONIIISSIONERS OF THE CITY OF PADUCAH, IENTUCKY: SECTION 1. That the Idayor be, and he is hereby, authorized and directed to execute, on behalf of the City of Paducah, Kentucky, a contract between the City and Ohio Valley Terminix Corporation of Evansville, Indiana, which contract is in words and figures as follows, to -wit: "THIS CONTRACT made and entered into on this the _ day of 1957, by and between the City of Paducah, Kentucky, party of the first part, hereinafter referred to as the "City", and Ohio Valley Terminix Corporation of Evansville, Indiana, party of the second part, hereinafter referred to as "Terminix", W I T N E S S E T H • "That the City hereby grants permission to Terminix; to install waste receptacles upon the public streets of the City in an amount not less than fifty (50) and not more than One Hundred (100). "The receptacles are to be of standard design and substantially constructed and are to be repaired and maintained by Terminix. "The receptacles will be emptied at proper times by the City. "Terminix shall have the right to sell advertising space on the four (4) sides of each receptacle, and shall pay to the City an amount equal to five percent (5a) of all moneys received from such advertising, such payments to be made on or before the fifteenth day of each calendar month for the preceeding calendar month. "Terminix shall .furnish and provide the City with indemnifying bond or insurance protecting the City and persons from all liability caused by the placing of such receptacles in the following amounts: sp10,000 for personal injury or death to any one person :?20,000 for personal injury or death to more than one person resulting from the samr accident, and 5,000 for damage to property in any one accident, including property owned by the City. 766 The term of this contract shall be for a period of five (5) years from the herein date.
