HomeMy WebLinkAboutOrdinances Book 13, Page 694, No Ordinance Number694 AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN PROPERTY FROM PADUCAH BASEBALL ASSOCIATION, INC. AND PROVIDING FOR THE TERI•IS AND CONDITIONS OF SAID PURCHASE WHEREAS, by a Resolution adopted by the Stockholders of Paducah Baseball Association, Inc. on January 17, 1957, said Paducah Baseball Association, Inc, offered to sell its land and improvements upon which Brooks Stadium is situated to the City of Paducah, Kentucky for park purposes for the purchase price of ,x25,000.00, subject to certain conditions which will be set out hereinafter, and WHEREAS, it is the desire of the Board of Commissioners of the City of Paducah, Kentucky to purchase said property for said price and under such terms and conditions. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF C0I9IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky purchase from Paducah Baseball Association, Inc. for the sum of �?25,000.00 the hereinafter described land in Paducah, Kentucky and the improvements thereon, to -wit: Beginning at a 3/4" iron pipe, on the east side of "C" Street, 189.01 south of the south east corner of the intersec- tion of Twenty-second Street and "C" S�reet, the same being the northwesterly corner of the herein conveyed lands; thence easterly at an exterior angle of 89017'-10" a distance of 1140' more or less to the northwest corner of a lot of ground conveyed to Metzger by August Wurth and others; thence with the easterly edge of said creek and the westerly line of the said Metzger lot and a lot of ground conveyed to Dixon by said August 'durth and others, a distance of 100' more or less; thence in an easterly direction and with the south line of said Dixon lot to the westerly line of the Old Paducah and Mayfield Road; thence in a southerly direction and with the west property line of the Old Paducah and I'9ayfield Road a distance of 26? more or less to the northerly line of the original Gus Veal lot; thence in a westerly direction and with the north line of the said Veal lot 159.8? to the northwest corner thereof; thence in a southerly direction, parallel with the Old Paducah and hayfield Road and with the west line of the said Veal lot 501 more or less to the northerly line of the Brewer lot hereinafter referred to; thence in a westerly direction and with the northerly line of the said Brewer lot a distance of 142?; thence in a southerly direction with the westerly line of the said Brewer lot and parallel with the Old Paducah and Mayfield Road a distance of 80, to the south westerly corner of said lot; thence in an easterl3Z direction and with the southerly line of the said Brewer lot a distance of 1471; thence in a southerly direction and parallel with the Old Paducah and Mayfield Road a distance of 110t to a stone in the northerly line of the hells Heath property (See plat of subdivision of property belonging to Wells Heath as recorded in Plat Book D, page 67); thence at an interior angle of 75027t in a westerly direction and along a linedividing this property and the Heath property a distance of 673.1? more or less to a stone said stone being located 685.01 from the eastroperty line of "C" Street; thence at an interior angle of 270°401 in a southerly direction and parallel with "C" Street along a line dividing the property of Wells Heath and the herein described property a distance of 363.051 to a stone in the southerly 695 property line of the herein described property; thence at an interior angle of 890221, in a westerly direction and along said southerly property line a distance of 6$5' to the east property line of "C" Street; thence in a northerly direction and along the east property line of "C" Street a distance of 363.451 more or less; thence at an interior angle of 17$0461-2011, con- tinuing along the east property line of ECS' Street a distance of 358.19, to the point of beginning, making an interior angle of 900421-5011 with the first described course. a n d Beginning at a point at the Southwest corner of the inter- section of 22nd Street and "C" Street; thence with the west line of "C" Street south 18 deg. 11 min. 40 sec. west 548.04 feet to a point on the west line of "C" Street; thence con- tinuing with the west line of "C" Street and south 16 deg. 58 min, west 363.38 feet to a point on the west line of "C" Street; thence southwardly, making an interior angle of 138 deg. 15 min, a distance of 45.89 feet; thence north 77 deg. 26 min. west, a distance of 50.23 feet; thence north 16 deg. 58 min. east and parallel with "C" Street, a distance of 403.93 feet; thence north 18 deg. 11 min. 40 sec., east and parallel with 11011 Street, a distance of 54$.04 feet to a point on the south line of 22nd Street 80 feet crest of "C" Street; thence Eastwardly and with the south line of 22nd Street a distance of 80 feet to the point of beginning; less those portions of same now used as streets, but to include said portions when and if said streets should be closed by legal proceedings; and being a strip of land 80 feet wide among the west line of "C" Street as shown on the plat of City of Paducah Municipal Housing Project KY 6-3, of record in Plat Book E, page 1 in the McCracken County Court Clerk's Office, except the south end of said strip which is not 80 feet in width but which is as shown on said plat. SECTION 2. It shall be a part of the consideration for the property as set out in Section 1 hereof, that at any time in the future should Professional League Baseball be resumed in the City of Paducah, said City will lease to Paducah Baseball Association, Inc. that part of the above described property occupied by Brooks Stadium and Ball Park for the sum of One Dollar (41.00) per year; and that the name of the property described above shall be "Brooks Park"; and that the property shall be kept and maintained by the City of Paducah as a city park and should same cease to be used as a city park, the title thereto shall revent to Paducah Baseball Association, Inc; however, in the event the stadium and park should be leased by the Paducah Baseball Association, Inc. the City is not to be responsible or charged with any upkeep or maintenance expenses in connection with the stadium and ball park during the term of such lease. SECTION 3. Upon receipt of a general warranty deed properly executed by Paducah Baseball Association, Inc. conveying the above described property to the City of Paducah, Kentucky free and clear of all liens and encumbrances, the City Treasurer is hereby authorized and directed to pay to said Paducah Baseball Association, Inc, the sum of •11¢25,000.00 and charge same to Account Number 7700. SECTION This ordinance shall be introduced and remain on file for public inspection for at least one (1) week in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
