HomeMy WebLinkAboutOrdinances Book 13, Page 678, No Ordinance Number678 A AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A LEASE ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, WITH THE BOARD OF EDUCATION OF THE CITY OF PADUCAH, KENTUCKY, FOR THE USE OF SCHOOL PROPERTY KNOWN AS "DUNBAR SCHOOL PROPERTY", IN THE CITY OF PADUCAH, IENTUCKY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized and directed to execute, on behalf of the City of Paducah, Kentucky, a certain lease from the Board of Education of the City of Paducah, Kentucky, covering school property known as "Dunbar School Property", which lease is in words and figures as follows, to -wit: "THIS LEASE, made and entered into on this day of , 19_, by and between THE BOARD OF EDUCATION OF THE.CITY OF PADUCAH, KENTUCKY, hereinafter referred to as +Lessors, and CITY OF PADUCAH, j KENTUCKY, a municipal corporation, hereinafter referred to as 'Lessee', is as follows, to -writ: "Lessor now owns certain property in the City of Paducah, Kentucky, referred to as the.'Dunbar�School Property' and more particularly � described as follow, to -wit: All of the property now owned by Board of Education of the City of Paducah located at the north east corner of the intersection of Yeiser Avenue and Tully Street and which was conveyed to said Board of Education by deed dated the day of 19 , and recorded in Deed Book, page in the ric racken County Court Clerk's office. "Lessor has used the said property for school purposes and temporarily does not need said property for school purposes, but Lessor anticipates a need'will arise for the use of said property for school purposes at a time which cannot how be ascertained. Lessee desires to use said property for park purposes and to make certain improvements thereon which will be beneficial to said prop- erty and to the public. "In consideration of an annual rental of One 01.00) Dollar to be paid by Lessee to Lessor on or before the 15th day of January of each year, during which this Lease may be in force, Lessor hereby leases to Lessee said property subject to the following terms and conditions: "1. This Lease shall be for a term of ten (10) years from January 1, 1957, provided however, this Lease may be terminated by Lessor at any time by serving written notice upon Lessee of its desire to terminate this Lease. Said notice may be by ordinary mail or said notice may be delivered in person to the City Manager or Mayor or the Chief Executive Officer of Lessee under any form of government which may be adopted hereafter. 679 112. It is understood that Lessee desires to install certain plumbing and other improvements to the building on said premises which will be useful for educational purposes. Plans and maximum costs of all of such improvements shall be approved in writing by Lessor before construction begins and if said plans are executed to the approval of Lessor, and if Lessor terminates this Lease prior to the end of the term hereof, then Lessor agrees to reimburse Lessee for a portion of the actual cost of said approved improvements. Such partial reimbursement shall be on the basis of ten (100) per cent per year for each full calendar yeat of time remaining during the term of this Lease from the date of such termination. Upon completion of any and all said improvements Lessee shall file with Lessor an itemized, detailed list of expenses for each of said improvements and said expenses as verified by Lessor, and Lessee at that time shall be used as a basis for reimbursement if this Lease is terminated as aforesaid. If Lessee desires to make improvements on said property which will not be useful for educational purposes in the opinion of Lessor, ,then Lessee may make such improvements upon the written approval of Lessor and said improvements shall be designated at the time as not subject to the reimbursement provisions of this paragraph. "3. Lessee shall maintain the improvements now on said property in a reasonable manner and return same to Lessor at the end of the term or at any prior termination of this Lease in as good condition as same is now in, ordinary weat and tear excepted. "If Lessee changes the grade of the land or makes any installa- tions or changes thereon which, in the opinion of Lessor, will interfere with the use of said premises for educational purposes, then Lessee, at the termination of this Lease, at any time shall restore said lamd to substantially its condition on January 1, 1957. No tree of more than five (5) inches in diameter, one (1) foot above ground level, be cut or damaged substantially by Lessee without the written consent of Lessor. 114. Lessee agrees to pay all insurance premiums on said prop- erty during the terms of this lease or such portion of the term as said property may be occupied by Lessee. "5. There is now stored within the building on said property certain desks, chairs and other furniture and equipment, and Lessee agrees to transport said furniture and equipment to such location within the City of Paducah as may be designated by Lessor. "6. If this Lease is terminated by any action on the part of Lessee, then Lessor shall not be obligated to pay any portion of costs 680 of improvements as set out in Paragraph 2. "IN TESTIMONY WHEREOF, the parties have caused this Lease to be executed this yaar and date first above written. That the City Treasurer be, and he is hereby, authorized and directed to pay to the Board of Education of the City of Paducah, Kentucky, the sum of Ten (;;)10.00) Dollars in full for the complete term of said Lease. SECTION 3.
