HomeMy WebLinkAboutOrdinances Book 13, Page 66, No Ordinance Number66 AN ORDINANCE PROVIDING FOR THE EiTIPLODIENT OF AN ATTORNEY OR ATTORNEYS TO INSTITUTE AND PROSECUTE SUITS FOR THE COLLECTION OF DELINQUENT AD VALOMPIr AND PUBLIC IMPROVEMENT ASSESSPIENTS; PRESCRIBING THE DUTIES OF SAID ATTORNEYS F FIXING THE AMOUNT OF COMPENSATION WHICH THEY SHALL RECEIVE FOR THEIR SERVICES BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That the City Dlanager be, and he is hereby, authorized to employ, on a contingent fee basis, an attorney or attorneys to institute and prosecute suits for the collection of delinquent ad valorem taxes and public improvement assessments against real estate. Said attorneys shall institute and prosecute suits in the McCracken Circuit Court for the enforcement of lier securing the payment of ad valorem taxes and public improvement assessments when so directed by the City Hanager, and shall do all things necessary to enforce said liens. The City Tanager shall cause the City Treasurer to prepare and deliver to said attorneys tax statements showing the amount of the liens against each parcel of property upon which suit is to be instituted, provided, however, that no suit shall be instituted unless the property is delinquent for ad valorem taxes for one year at least three years prior to the time the statement is prepared. The attorneys shall exercise due care and diligence in the preparation and prosecution of such suits; shall inspect each piece of property before it is sold at the Diaster Commissioner's sale and shall attend each sale and submit bids for the City as may be instructed by the City Manager. Said attorneys shall have the entire responsibility for the examination of the titles to the properties involved in each of said suits, and at the time of the closing of any suit by distribution of the proceeds of sale shall submit to the City Manager a certificate stating that the owners of the legal title and all persons having any interest in the property sold were joined as defendants and were properly proceeded against. Said attorneys shall make such reports as may be requested by the City Manager. The City of Paducah shall not incur any court costs or other litigation expense without the approval of the City Manager. SECTION 2. The compensation to be paid to said attorneys in each suit shall be an amount equal to 25; of the delinquent taxes, interest and penalties collected. SECT_ IONS Any contract executed by the City Manager and any attorney or attorneys shall be subject to termination at any time, provided, however, if terminated by the City Manager, the attorney shall have a period of four (4) 67 months for the closing of any unfinished cases, and shall be entitled to receive compensation for all closed within such period of time. SECTION 4. No contract executed under the provisions of this ordinance shall be binding until a copy of same has been approved by Resolution duly adopted by the Board of education of the City of Paducah, Kentucky, SECTION 5.
