HomeMy WebLinkAboutOrdinances Book 13, Page 474, No Resolution Number474 A RESOLUTION RECITING THE NEED FOR ACQUIRING CERTAIIN LAND OWNED BY MARSHALL GRAY AND ViIFE, BEATRICE GRAY, AND THE HEIRS OF J. T. Y.EBLER, DECEASED, TO BE USED AS A SITE FOR THE CONSTRUCTION OF THE SEWERAGE DISPOSAL PLANT, AND PROVIDING AND AUTHORIZING THE CONDEIMIATION OF SAME WHEREAS, heretofore the Board of Commissioners of the City of Paducah has adopted an ordinance authorizing the construction of a s ewerage disposal plant, and WHEREAS, a certain portion of the land upon which such plant is to be constructed is owned by Marshall Gray and wife, Beatrice Gray, and the heirs of -J. T. Kebler, deceased, and WHEREAS, the said 'Marshall Gray and wife, Beatrice, have heretofore executed an option to the City of Paducaig for the purchase of such tract at the purchase price of ;'150.00, and WHEREAS, the said Marshall Gray and wife, Beatrice Gray, are unable to deliver to the City of Paducah a General Warranty deed to same because of a defective and incc4plete title, and WHEREAS, it will be necessary to institute condemnation proceedings in McCracken Circuit Court to perfect the title. NO?^I THEREFORE, BE IT RESOLVED BY THE BOARD OF COP��IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Corporation Counsel be, and he is hereby, directed and authorized to institute condemnation proceedings in McCracken Circuit Court against Marshall Gray and wife, Beatrice Gray, and the heirs of J. T. Kebler, deceased, to acquire title to the herein- after described tract of land. A tract of land situated and being in the City of Paducah County of McCracken and State of Kentucky containing approx- imately 1.47 acres, situated near the end of North Sixth Street and west of Terrell Street and beginning at a point on the west line of Block 81 in Harris, Flournoy, Trimble and Norton's Addition where same is intersected by the south line of the floodwall right-of-way; thence north 86 degrees 35 minutes west with the south line of said floodwall right - of -fray 408.22 feet; thence southerly and with an interior angle of 95 degrees 29 minutes 371 seconds, 99.3 feet to the northwest corner of a tract of land conveyed to Marshall Gray and wifa, Beatrice Gray by deed recorded in Deed Book 331, page 166 in the McCracken County Court Clerk's office; thence eastwardly with an interior angle of 101 degrees 10 minutes 522 seconds with the line of said Gray land 412.38 feet to a point on the west line of the aforesaid Block 81; thence northwardly and with the west line of said Block $1 217.3 feet to the point of beginning. SECTIOD 2., This resolution shall be in full force and effect from andaTter its adoption.
