FALLS CONSTRUCTION COMPANY OF THE BALANCE OWING ON THE .CONTRACT PRICE FOR THE CON- STRUCTION OF STORM SEWER PROJECT NO. KY 15 -CF -8 WHEREAS heretofore the City of Paducah, Kentucky contracted with D. W. Falls Construction Company for the construction of a storm sewer project known as Project No. KY 15 -CF -8 to be financed by a grant from the Housing and Home Finance Agency of the United States of America, and WHEREAS said project has been completed by said D. W. Falls Construction Company and the unpaid portion of the contract price amounts td $57;0$3.40, and WHEREAS the City of Paducah now has said amount on hand from -funds granted by the aforesaid Housing and Home Finance Agency, and WHEREAS certain claims have been presented to the City for damages'alleged to have been caused by the said D. W. Falls Construction Company; and WHEREAS arrangements have been made for the payment of all of said claims except those made by R. C. Jennings, Mrs. John McKnight and Universal Concrete Pipe Company, and WHEREAS D. W. Falls Construction Company, with American Automobile Insurance Company as Surety, has executed an Indemnifying Agreement protecting the City from any loss resulting from the R. C. Jennings Claim, and WHEREAS Reed & Hines, Attorneys for D. W. Falls Construction Company, have placed in escrow with the City Treasurer an amount in excess of the claim of Mrs. John McKnight „and WHEREAS Universal Concrete Pipe Company has withdrawn its claim and consented to the payment of the balance due. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1._ That the balance of $57,0$3.40 due D. W. Falls Construction Company as final payment for the construction of storm sewers known as Project No. KY -15 -CF -8, be allowed, and that the City Treasurer be, and he is hereby, authorized to pay same from funds in the Housing and Home Finance Agency account in his hands. SECTION 2.
