WH -PEAS by the above entitled Resolution the City Treasurer
was authorized and directed to issue a check to the order of D. W.
FALLS COI'STRUCTI01' CO=�PAHY II; THE SV: OF 357,083.40 drawn upon the
HIIFA Sewer Account Project No. KY 15 -CF -8 as final payment for the
construction of storm severs under said project, and also authorized
and directed to deliver said check to the Corporation Counsel of the
City of Paducah to be delivered to D. W. Falls Construction Company,
or its attorneys upon the settlement of certain damage ckaims against
said D. i1. Palls Construction Company, and
iP EREAS said damage claims have not been settled, and
IIHEREAS since the adoption of said Resolution a claim in the
amount of '50,3'6.52 has been filed by Universal Concrete Pipe Company
against any monies due or to become due to said D. W. Falls Construction
Company, and also a claim has been filed by Charles A. Williams, attorney
for R. C. Jennings a„ainst said D. W. Falls Construction Company in the
amount 6f •118,692.15; and
i9HEREAS the total of said claims exceeds the aforesaid amount
due as the balance of said contract;
17.0:1 THEREFORE, BE IT RESOLVED BY THE BOARD OF COI,12ISSIOI?ERS 0
TO CITY OF PADUC AH, KE11TUCKY: °
SECTION 1. That the Resolution containin;• the title quoted
above, rwhich was adopted by the Board of Cormaissioners on July 26, 1955,
be, and the same is hereby, repealed.
SECTIO-- 2. This Resolution shall be in full force and effect
from and after its adoption.
