A RESOLUTION AUTHORIZING THE PATKENT TO D. If. FALLS CONSTRUCTION
COT-TANY OF THE BALANCE OWIDiG ON THE CONTRACT PRICE FOR THE CON-
STRUCTION OF STORid MIER PROJECT N0. ICY 15 -CF -8 SUBJECT TO CERTAIN
CONDITIONS
11HEREAS heretofore the City of Paducah, Kentucky contracted
with D. 111. Falls Construction Company for the construction of a storm
sewer project known as Project No. KY. 15 -CF -8 to be financed by a
grant from the Housing and Home Finance Agency of the United States
of America, and
IJHEREAS said project has been completed by said D. W. Falls
Construction Company and the unpaid portion of the contract price
amounts to ;?57,083.40, and
WHEREAS the City of Paducah now has said amount on hand from
funds granted by the aforesaid Housing and Home Finance Agency, and
I^HEREAS certain claims have been presented to the City for
damages alleged to have been cuased by the said D. If. Falls Construction
Company, and
HIVEREAS the City of Paducah, Kentucky now desires to pay to the
said D. W. Falls Construction Company the aforesaid balance due it
provided said claims for damages are settled.
1d01.1 THEREFORE, BE IT RESOLVED BY THE BOARD OF COT- •iISSIONERS OF
THE CITY OF PADUCAH, IENTUCKY_:
SECTION 1. That the balance of 057,083.40 due D. If. Falls
Construction Company as a final payment for the construction of storm
sewers known as Project No. KY 15 -CF -8 be allowed, and that the City
Treasurer be, and he is hereby, authorized to pay same from the Housing
and Home Finance Agency funds in his hands subject to the hereinafter
set out conditions and provisions.
SECTION 2. The City Treasurer is hereby authorized and directed
to issue a check to the order of D. W. Falls Construction Company
in the sum of ;;57,0$3.40 drawn upon the HIIFA Sewer Account, Project
Ido. KY 15 -CF -8, and is hereby authorized and directed to deliver said
check to the Corporation Counsel of the City of Paducah, Kentucky
to be delivered to D. W. Falls Construction Company, or its Attorneys,
Reed and Hines, upon the settlement of the following damage claims
against said D. W. Falls Construction Company:
The Country Club of Paducah in the amount of ;?189.50
Mrs. E. R. I-lcBride in the sum of ;1225.00
Mrs.' John McKnight in the sum of :;?80$.50
The Paducah Park Board for damages
to Noble Park in the sum of N620.00
The City of Paducah for damages to
streets in the sum of "?2,000.00

SECTION 3, The Corporation Counsel is hereby directed and
authorized to accept certified checks payable to the above claimants
in the aforesaid sums or to accept escrow receipts :from any bank in
Paducah shown{, that the above amounts are held in escrow for the
protection of the City.
SECTIOR 4, This Resalution shall be in :full force and effect
from and after its adoption.
