$59,244.00 FOR FURNISHING ALL MATERIAL AND WORK FOR ALTERATIONS TO DRAINAGE
PUMP STATION IN STORM SEWER PROJECT NO. KY 15 -CF -8 IN THE CITY OF PADUCAH,
KENTUCKY; PROVIDING THAT THE MAYOR EXECUTE A CONTRACT ON BEHALF OF THE CITY
OF PADUCAH, KENTUCKY, WITH CHISM & MILLER FOR SAID MATERIAL AND WORK, AND
PROVIDING THE TERMS AND CONDITIONS OF SAID CONTRACT; PROVIDING THAT SAID
ACCEPTANCE OF SAID BID AND CONTRACT FOR SAID MATERIAL AND WORK BE CONDITIONED
UPON THE APPROVAL AND ACCEPTANCE THEREOF BY THE HOUSING AND HOME FINANCE AGENCY
OF THE UNITED STATES OF AMERICA
WHEREAS, the City of Paducah, Kentucky, advertised for bids for certain
material and work for alterations to Drainage Pump Station No. 1 in Storm
Sewer Project No. KY 15 -CF -8 in Paducah, Kentucky, and
WHEREAS, bids were submitted by oontractors on said material and work
in accordance with the "Notice to Bidders, Instructions to Bidders, Proposal
Form, Bond Form, Contract Agreement Form, General Conditions, Special Conditions
and Specifications for Storm Sewer" which was prepared by Black & Veatch,
Consulting Engineers, and
WHEREAS, the lowest bid for said material and work was in the amount
of $59,244.00 and was submitted to Chism & Miller, and
WHEREAS, it is believed said bid should be accepted by the City of
Paducah if it is approved by the Housing and Home Finance Agency of the United
States of America.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMIISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah, subject to the conditions herein
set out, approve and accept the bid of Chism & Miller in the amount of
$59,244.00 for material and work for alterations to Drainage Pump Station No. 1
of the Storm Sewer Project No. KY 15 -CF -8 in Paducah, Kentucky. Approval and
acceptance of said bid is subject to all the terms and conditions contained in
the document of which said bidder based his bid on said work, this document
having been prepared by Black &.Veatch,: Consulting Engineers of Kansas City,
Missouri, and entitled: "NOTICE TO BIDDERS,.:INSTRUCTIONS TO BIDDERS, PROPOSAL
FORM, BOND FORM, CONTRACT AGREEMENT FORM, GENERAL CONDITIONS, SPECIAL CONDITIONS
AND SPECIFICATIONS.It
SECTION 2. Acceptance of the bid of Chism & Miller and of the contract
as set out in Section 1 herein shall be conditioned upon the final approval of
bid of said contractor and the authority to the City to enter into a contract
therefor from the HHFA of the United States of America and until said approval
and authority is given and received neither the City nor the Contractor will
be obligated except that each will be obligated to comply with the directions

of said governmental agency and the decision of said agency shall be binding
them. If final approval for the entire work by said contractor is granted by
said governmental agency it is agreed that the parties will properly execute
contract or contracts containing all the terms of said �ontractorts bid and t
said contract shall be in the form of the contract in Black & Veatch's "Notic
to Contractors, Instructions to Bidders, Proposal Form, Bond Form, Contract
Agreement Form, General Conditions, Special Conditions and Specifications for
Storm Sdwers", and shall contain all the terms, specifications and conditions
thereof subject to such changes as may be required by the HHFA.
SECTION 3. It is further provided that said.bid is accepted and said
contract is authorized as herein provided subject to payment therefor from grants
of money from the HHFA and that said Contractor will be paid for said work from
funds received from said grant and the City of Paducah shall in no wise be obligated
under said contract for payments out of any other revenues.
SECTION 4. The mayor of the City of Paducah is hereby authorized to
execute a contract, for and on behalf.of the City of Paducah, with Chism & Miller,
said contract to contain all of the terms and conditions of this ordinance and
such other terms and,conditions.as provided for in the bid of Chism & Miller.
SECTION 5. This ordinance shall be introduced at a meeting of the Board of3
Commissioners of the City of Paducah, nentucky, and remain on file for at least
one (1) week for public inspection in the completed form in which it shall be
put upon its final passage, but it being necessary for the public health and
safety of the City of Paducah, Kentucky that said work and material for such
alterations be installed as soon as possible to complete the aforesaid storm
sewer project, an emergency is hereby declared.to exist and this ordinance
shall be in full force and effect from and after its adoption.
