A -RESOLUTION ACCEPTING THE WORK OF D. W. FALLS CONSTRUCTION
COMPANY, INC. FOR FIVE '(5) SECTIONS OF STORM SEWER CONSTRUCTION
IN THE CITY OF PADUCAH, KNOWN AS PROJECT NUMBER KY 15 -CF -8, AND
PROVIDING THE TERMS AND CONDITIONS OF SUCH ACCEPTANCE
WHEREAS, heretofore by ordinance adopted by the Board of
Commissioners of the Uity of Paducah, Kentucky, D. W. Falls
Construction Company, Inc. was awarded a contract for the con-
struction of five (5) sections of storm storm sewer construction in the
City of Paducah known as Project No. KY 15=CF-8, said sections
being known as Noble Park Outfall Sewer, 30th Street Relief Sewer,
27th Street Relief Sewer, Cruse Avenue Sewer and Branch Sewer, and
WHEREAS, it appears that each of said sections of said sewer
project have been completed according to plans and specifications,
and
WHEREAS, it appears that in the construction of said project
the said D. W. Falls Construction Company or its Agents, officers,
employees or sub -contractors have caused certain damage to private
and public property, which damages have not been repaired or corrected.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the services performed by D. Ul. Falls Construction
Company, Inc. in the construction and completion of.all five (5) sections
of the Storm Sewer Project known as Project No. Ky 15 -CF -8 be accepted
as completed by the City of Paducah, Kentucky subject to the terms and
conditions of Section 2 of this resolution.
SECTION 2. This resolution shall in no manner waive any liability
of D. W. Falls Construction Company, Inc. or its agents, officers,
employees or sub -contractors for any damages done to public and private
property and shall not relieve the said D. W. Falls Construction Company
Inc. from performing the maintenance work in connection with said
project as provided in the terms and specifications contained in -the
construction contract, -and shall not relieve the surety upon the bond
executed by said D. W. Falls Construction Company, Inc. from any
liability for such damages and maintenance.
SECT_ IONS This Resolution shall be in full force and effect
from and after its adoption.
