HomeMy WebLinkAboutOrdinances Book 13, Page 219, No Ordinance Number219 AN ORDINANCE AUTHORIZING THE PURCHASE OF AN EASEI4ENT OVER CERTAIN LAND OF W. E. HARRIS AND WIFE, ALICE C. HARRIS, FOR PUBLIC PURPOSES, AND PROVIDING THE TERMS AND CONDITIONS OF SUCH PURCHASE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky, purchase from W. E. Harris and wife, Alice C. Harris, a perpetual easement over the following described land situated in the City of Paducah, County of Mccracken and State of Kentucky: "Beginning at a point on the north line of 32nd street where same is intersected by the west line of what is known as the floodwall right of way land; thence northwardly and with the west line of said floodwall land 445 feet more or less to a point opposite Station 19600 of said floodtirall right of way; thence at right angles westwardly 10 feet to a new point in the west line of said floodwall land; thence with the west line of said floodwall land northwardly 780 feet, more or less to the south line of Park Avenue; thence westwardly with the south line of Park Avenue 140 feet more or less, to the northwest corner of the herein described tract of land; thence south- wardly and parallel with the west line of said floodwall land 130 feet, more or less, to a point directly opposite what is known as Station 190/00 of the floodwall right of way; thence at right angles eastwardly 45 feet to another point directly opposite said station; thence southwardly and parallel with the west line of said floodwall land 600 feet, more or less, to a point directly opposite Station 196/00 of the floodwall right of way; thence at right angles eastwardly 15 feet to another point directly opposite said station; thence southwardly and parallel with the west line of said floodwall land 410 feet, more or less, to a point on the north line of 32nd Street; thence southwasterly with -the said line of 32nd Street 90 feet, more or less, to the point of beginning." Being a part of the same land conveyed to W. E. Harris and wife, Alice C. Harris, by J. C. Johnson, Jr. by deed dated August 6, 1947, of record in Deed Book 260 page 184 in the McCracken County Court Clerk's office. Said easement being purchased for use by the City for sewer purposes, including enclosed sewer and open sewer, and also for purpose of constructing an outlet structure and a flap gate or gates and other purposes necessary for storm water sewer purposes. The purchase price to br paid by the City for said easement is the sum of Two Thousand Five Hundred ($2,500.00) Dollars, and after approval of the Housing and Home Finance Agency of the United States of America, the City Treasurer is hereby authorized and directed to pay said sum to W. E. Harris and wife, Alice C. Harris, in full payment for said easement, the same to be charged to the Acquisition Account under Project KY 15 -CF -8. 220 SECTION 2. This ordinance shall be introduced and remain on file for public inspection for at least one (1) week in the completed form in which it shall be put upon its final passage.
