HomeMy WebLinkAboutOrdinances Book 13, Page 180, No Ordinance NumberAid ORDINANCE AUTHORIZING THE IdAYOR AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, A QUIT -CLAIM DEED TO SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY, A CORPORATION, CON- VEYING A PORTION OF A UTILITY EASEMENT SOUTH OF QUARLES AVENUE IPI PADUCAH, KENTUCKY WHEREAS, on July 27, 1954 the Board of Commissioners of the City of Paducah adopted an ordinance authorizing the closing of a part of a utility easement across the property of Southern Bell Telephone and Telegraph Company on the south side of Quarles Avenue in Paducah, Kentucky, and thereafter pursuant to KR.S 94.360 a judgment was obtained in McCracken Circuit Court ordering the closing of such portion of said utility easement, and WHEREAS, the Southern Bell Telephone and Telegraph Company has requested a quit -claim deed from the City of Paducah, Kentucky conveying such portion in order to perfect its title. NOW THEREFORE BE IT ORDAINED BY THE BOARD OF C017,11S3IONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Payor and City Clerk be, and they are hereby authorized and empowered to execute a quit -claim deed from the City of Paducah, Kentucky to Southern Bell Telephone and Telegraph Company, a corporation, conveying all right, title and interest of the City of Paducah, Kentucky in the utility easement across the property of Southern Bell Telephone and Telegraph Company south of Quarles Avenue in Paducah, Kentucky except the following: "Beginning at an iron pin, a point on the south line of Quarles Avenue, said point being 729.10 feet East of the intersection of the South line of Quarles Avenue and the East line of the Mayfield Road; thense south 73 degrees 13 minutes East 60.0 feet to an iron pin on the south side of Quarles Avenue; thence in a southerly direction south 3 degrees 06 minutes west 211.18 feet to an iron pin in the line of Ellen E. Metzger, this line being parallel to the Mayfield Road; thence with the line of Said Ellen E. Metzger north 74 degrees 44 minutes west 59.64 feet to an iron pin in said Ellen E. MetzgerTs line; thence north 3 degrees 06 minutes East 212.$0 feet, this line being parallel to the Layfield Road, to the point of beginning, and containing 0.29 acres, more or less." SECTION 2.
