HomeMy WebLinkAboutOrdinances Book 12, Page 952, No Ordinance Number952 AN ORDINANCE PROVIDING FOR THE GRANTING OF A PERI•1IT TO GUTHRIE HAY TO CONSTRUCT CONCRETE STREETS, CURBS AND SIDEWALKS AND TO LAY AND CONSTRUCT S9,11ITAR`1 SEWERS III BROOKHAVEN ADDITION AND ALSO ON ALABAMA STREET IN CORNELL PLACE ADDITION PRESCRIBING THE SPECIFICATIONS, TERI.--S AND CONDITIONS FOR SAID II•PROVEI, NTS. BE I^1 ORDAINED BY THE BOARD OF COM-IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah grant to Guthrie iiay, Licensee, the right and privilege to make certain public improvements in Brookhaven Addition to the City of Paducah and on Alabama Street as shown on the plat of Cornell Place in said City, said improvements to consist of laying and constructing concrete streets, curbs, driveways and sidewalks on the street right of way in said Brookhaven Addition and along Alabama street in said Cornell Place Addition; that in addition there is also authorized the laying of certain sanitary sewers along and under the street right of way in Brookhaven Addition and the connecting of said sewers with existing mains of the city in that vicinity. The privilege of making the aforesaid improvements by said Guthrie Ploy is granted on the following terms and conditions: (1) All expenses for labor and materials furnished and used in connection with said construction shall be paid for by the Licensee. (2) All of said street, curb, sidewalk, driveway and sewer construction shall be done and performed in conformance with plans and specifications received and filed this date with the Board of Commissioners. (3) The Licensee shall be responsible for the proper performance of said work according to this ordinance and shall be'liable to the City of Paducah for any repair or replacement of any of said work caused by the failure of the Licensee to so perform said work. (4) Said improvements, after being so constructed and after said con- struction is approved by this Board and accepted by proper motion, shall become the property of the City which shall assume the responsibility for their future maintenance and repair, provided further, however, that the licensee shall guarantee said work against defects in workmanship and materials. (5) The City of Paducah shall in no way be responsible for the cost of constructing said improvements or any part thereof, nor shall the City be liable for any defects thereof should said streets be constructed otherwise than specified in said plans and specifications and as provided herein. (6) It is agreed that said street pavement will be a concrete slab 30 feet wide having a six (6) inch curb on each side thereof; all of said pavement to be 5 inches thick at the gutters, graduating to a thickness of seven (7) inches at the crown which shall be the center of the streets. 953 (7) It is agreed that the sidewalk shall be a concrete slab five (5) feet in width and five (5) inches in thickness. i (8) All concrete used in the construction of said streets, curbs and sidewalks shall be mix test 3,500 pounds per square inch, limestone aggregate. (9) Licensee shall be liable for any injuries to persons or property resulting from negligence or misconduct during the performance of said work and wi.1 i hold the City of Paducah harmless therefor, and said licensee agrees to maintain at all times during progress of said work a liability policy or policies in aconi- parry or companies licensed and doing, business in the State of hentucky, insuring;: . Licensee and the City of Paducah from damages to persons or property during said construction in the following amounts: :,;20,000 for damage or injury to any one person; :,x40,000 for damage or injuries to more than one person in any one accident and ;,.'5,000 for damage to property in any one accident. Said policies shall be approved by the City Treasurer and filed with the Board of Commissioners of said City. SECTION 2. The license granted herein shall extend for a period of one year from the adoption of this ordinance. SECTION 3.
