HomeMy WebLinkAboutOrdinances Book 12, Page 944, No Ordinance Number944 AN ORDINANCE RELATING TO THE ESTABLISHIvMNT OF A CIVIL DEFENSE AGENCY III THE CITY OF PADUCAH, KENTUCKY, UNDER AND PURSUANT TO THE PROVISIONS OF "AN ACT CONCERNING CIVIL DEFENSE", BEING CHAPTER 58 OF THE ACTS OIC' THE GENERAL ASSEMBLY OF THE C01-110111WEALTH OF KENTUCKY, ADOPTED AT ITS 1952 SESSION; PROVIDING FOR THE APPOINTMENT OF A DIRECTOR OF CIVIL DEFENSE AND PRESCRIBING THE POsIERS AND WTIES TO BE VESTED IN SUCH AGENCY AND IN THE RIEDBERS THEREOF; AND REPEALING ALL ORDINANCES IN CONFLICT THEREITITH 11MREAS, Under Senate Bill 153 adopted at the 1952 session of the General Assembly of the Commonwealth of Kentucky, being Chapter 58 of the Acts of 1952, a Civil Defense Agency of the Commonwealth of Kentucky was created, said agency to be directed and supervised by the Adjutant General who shall be the director thereof and who shall be responsible to the Governor for carrying out the program for Civil Defense of the State; and 1'iIIEREAS, the aforesaid enactment has enabled the Commonwealth to provide an efficient organization for the carrying out of all emergency functions in the event of enemy attack, sabotage or other hostile action, or by fire, floor or other causes; and I'MEREAS, it is provided under Section 16 of said act that "Each county and city of this state is hereby authorized and directed to establish a local organization for Civil Defense in accordance with the State Civil Defense Plan and Program" and that "The county judge of each county and. the chief executive of each city or governing body thereof is authorized to appoint a director who shall have direct responsibility for the organization, administration and opera of such local organization for Civil Defense, subject to the direction and cont of such appointing officer or governing body.' NUJ THEREFORE, BE IT ORDAINED BY THE BOARD OF COM-IISSIOUTERS OF THE CITY OF PADUCAH; SECTION 1. As used in this ordinance, the term "Civil Defense' shall mean the preparation for and the carrying out of all emergency functions, other than functions for which military forces or other Federal agencies are primarily responsible, to prevent, minimize and repair injury and damage resulting from disasters caused by enemy attack, sabotage, or other hostile action, or by fire, flood or other causes. These functions include, without limitation, fire fighti services, p6lice services, medical and health services, rescue, engineering, air warning services, communications, radiological, chemical and other special weapons of defense, evacuation of persons from stricken areas, emergency welfare services, emergency transportation, plaht protection, temporary restoration of public utility services, and other functions related to civilian protection, together with all other activities necessary or incidental to the preparation for and carrying out of the foregoing functions. 945 SECTION 2. The Mayor as the chief executive officer of the City of Paducah shall have the power to declare schen there exists in the city a disaster or emergency requiring the carrying out of the emergency functions under this ordinance to preserve the lives and property of the people of this state, and generally to protect the public peace, health and safety. SECTION 3. There is hereby created in the City of Paducah an agency to be known as the ^Civil Defense Agency', with a director who shall be appointed by the T•iayor with the approval of the Board of Commissioners, and the direEtor shall have the entire responsibility for the orjanization, administration and op- eration of such local organizations for Civil Defense, subject to the direction and control of the Mayor. SECTION 4. The Civil Defense Agency, by and through the director thereof, shall have the power and authority: (1) To expend funds for purchase of equipment, materials and supplies for Civil Defense purposes when the expenditure of funds for such purposes is authorized by the legislative body of the city. (2) To direct and coordinate the development of Civil Defense plans and programs in accordance with the policies and plans prescribed by the federal and State Civil Defense Agencies; (3) To appoint, employ, remove, or provide, with or without com- pensation, air-raid wardens, rescue teams, auxiliary fire and police personnel, and other civilian defense workers; (4) To establish a primary and one or more secondary control centers to serve as command posts during an emergency; (5) Subject to the order of the Governor, or the chief executive of the county or city, to assign and make available for duty, the employes, property, or equipment of the county or city relating to fire fighting, engineering, rescue, health, medical and related services, police, transportation, construction, and similar items or services for civil defense purposes and within or outside of the :. physical 'limits of the county or city; (6) In the event of enemy attack or state of emergency, to waive procedures and formalities otherwise required by the law pertaining to: the performance of public work, entering into contracts, the incurring of obligations, the employment of permanent and temporary workers, the utilization of voluntees workers, the rental of equip- ment, the purchase and distribution, with or without compensation, of supplies, materials and facilities, and the appropriation and expenditure of public funds. (7) To have all other powers vested in the Civil Defense Agency of a city, or in the director thereof, under the provisions of said act. SECTION 5. The members of 'the auxiliary police selected by and to serve under the Director of Civil Defense when a state of emergency is declared by the Mayor shall not exceed 50 in number and they are hereby authorized and empowered to carry arms and to make arrests, and they shall have all of the powers and responsibilities of other police officers of the Commonwealth of Ifentucky. Each such officer shall, before entering upon the performance of his duties, execute a bond, with corporate surety, to be approved by the City Treasurer, said bond to be in the same amount and to contain the same terms and conditions as bonds executed by regular police officers of the City. The premium for such bonds shall be paid by the City of Paducah. SECTION 6. All members of the auxiliary police force and of the auxiliary fire department shall serve under this ordinance pursuant to the pro- visions of the aforesaid enactment of 1952, and no member shall acquire any right under the rules of civil service governing regular police officers and firemen of the City of Paducah. SECTION 7. No member of the auxiliary police force or of the auxiliary fire department, and no employee or appointee of the Civil Defense Agency shall receive any compensation for his or her services. SECTION 8. All ordinances and parts of ordinances in conflict herewith are, to the extent of suer conflict, hereby repealed. SECTION., 9.
