HomeMy WebLinkAboutOrdinances Book 12, Page 918, No Ordinance Number918 AN ORDINANCE PROVIDING FOR THE PURCHASE OF CERTAIN L1ND FOR STREET RIGHT OF WAY PURPOSED ON THE SOUTH SIDE OF MONROE BETWEEN 8th & 9th STREETS AND PRESCRIBING THE TERMS AND CONDITIONS FOR SAID PURCHASE. WTERLAS, it is necessary to further widen Monroe Street between 8th and 9th Streets in the City of Paducah, said widening to require an additional right of way of 23 feet along the said portion of Monroe Street, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, I=UCICY: SECTION 1 That the City of Paducah purchase from the owners of property abbutting the present south line of Monroe Street betmen 8th and 9th Streets two certain strips of land to wit: the first strip, referred to as the E. P. Shelton property, fronting 23 feet on the west side of North Eight Street and extending a uniform width of 23 feet along the present south right of tray line of Monroe Street toward 9th Street a distance of 173.25 feet; the second strip, referred to as the Thomas W. Wilson. property, fronting 23 feet on the east side of North 9th Street and extending a uniform width of 23 feet along the present south right of way lin a of Monroe Street toward 9th Street a distance of 173.25 feet toward 9th Street. The owners of each of said two parcels of land shall be paid the sum of $1.000.00 per parcel but said purchase price shall only be paid upon delivery by the owners of said property to the City of Paducah a good and sufficient general warranty deed conveying the fee simple, unemcumbered title to sante. As an inducement to the oimers it is agreed that neither the remaining property adjacent to that to be conveyed, nor said owners idal, be liable for costs of street improvements, and that said party grantors may remove shu berg, hedges and plants from the property so conveyed prior to the improvement of said street. SECTION 2 The City Manager is authorized and directed to purchase the properties, or either of them, designated in Section 1 on the terms therein specified and to receive a good deed to same to be prepared by the vorporatioa 'oxisel, aid to pay for same out of the account for acquisition of real estate. SECTION 3 This ordinance shall be in full force and effect from and after its adoption.
