HomeMy WebLinkAboutOrdinances Book 12, Page 898, No Ordinance Number898 AN ORDINANCE PROVIDING FOR THE ArMNDMENT OF THE SIXTH SUPPLEMENTAL CONTRACT ENTERED INTO BETWEEN THE CITY OF PADUCAH AND THE PADUCAH BUS COMPANY ON JUNE 24, 1952, UNDER THE PROVISIONS OF AN ORDINANCE ENTITLED: ??AN ORDIMCE DIRECTING THE CITY MINAGER OF THE CITY OF PADUCAH, KENTUCKY, TO SELL A FRANCHISE AUTHORIZING THE PURCHASER TO MAINTAIN AND OPERATE MOTOR PASSENBER BUSES OVER AND UPON THE STREETS, AVENUES AND PUBLIC WAYS OF THE CITY OF PADUCAH, AND FIXING THE TERMS AND CONDITIONS OF THE EXERCISE OF SAID GRANT," WHICH ORDINANNCE KNOTN! AS "MOTOR BUS FRANCHISE NO. 211 WAS ADOPTED ON FEBURARY 1, 1944; SAID AMENDED CONTRACT TO BE REFERRED TO AS THE SEVENTH SUPPLIMMITAL CONTRACT; PRESCRIBING THE TERMS AND CONDITIONS TO BE CONTAINED IN SAID AMENDED CONTRACT AND AUTHORIZING THE MYOR TO EXECUTE SAID A11ENDED CONTRACT FOR AND ON BEHALF OF THE CITY OF PADUCAH; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF CO,QiISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1 That Subsections (a), (b) and (d) of Paragraph numbered 2 and that Paragraph numbered 4 of the Sixth Supplemental Contract entered into between the City of Paducah and the Paducah Bus Company on JLue 24, 1952, which Paragraphs of said contract are in words and figures as follows, to -wit: t'(2) That until the cancellation of this contract in the manner here- inafter provided, the company shall maintain as a minimum the operation of buses over the following routes now established and in effect and under the following schedules: (a) Arcadia Route extending from 3rd and Broadway south on 3rd Street I I to Kentucky Avenue; thence west on Kentucky Avenue to 9th Street; thence north to Broadway; thence west on Broadway to the intersection of the Lone Oak Road and I Blandville Road and return to 3rd and Broadway, with operating schedule making bus service] available at intervals of time not exceeding 40 minutes from each regular stop on said Route. I (b) Avondale Route extending from 3rd and Broadway south on 3rd Street to Kentucky Avenue; thence west on Kentucky Avenue to 9th Street; thence north to Broadway; thence west to the intersection of 37th and Central Avenue and return to 3rd and Broadway, with operating schedule making bus service available at intervals of time not exceeding 40 minutes from each regular stop in said Route. 899 (d) Guthrie Avenue Route extending from 3rd and Broadway south on 3rd Street to Kentucky avenue; thence west on Kentucky Avenue to 9th Street; thence north to Broadway; thence from 9th and Broadway to Schneidman Road and Markham Street intersection and return to 3rd and Broadway with operating schedule making bus service available at intervals of time not exceeding 20 minutes from each regular stop on said route. (4) Except as modified by this Sixth Supplemental Contract all the terms, agreements, conditions and convenants contained in the aforesaid Fifth Supplemental Contract and the aforesaid franchise ordinance shall remain and continue in full force and effect and the same shall be in effect until the cancellation of this contract in the manner set out ab6ve.11 (a) Arcadia Route extending from 3rd and Broadway south on 3rd to Kentucky Avenue; thence west on Kentucky Avenue to 17th Street; thence north to Broadway; thence west on Broadway to the intersection of Lone Oak Road and Blandville Road and return to 3rd and Broadway with operating schedule making bus service available at intervals of time not exceeding 40 minutes from each regular stop on said Route. (b) Avondale Route extending from 3rd and Broadway south on 3rd v Street to Kentucky Avenue; thence west on Kentucky Avenue to 9th Street; thence north to Jefferson Street; thence west to the intersection of 36th and Pines Road and return to 3rd and Broadway, with operating schedule making bus service available at intervals of time not exceeding 40 minutes from each regular stop on said Route. (d) Authrie Avenue Route extending from 3rd and Broadway south on 3rd to Kentucky Avenue; thence west on Kentucky to 19th Street; thence south on 19th Street to Schneidman Road and Markham Street intersection and return to 3rd and Broadway, with operating schedule making bus service available at intervals of time not exceeding 20 minutes from each regular stop on said Route. (4) Except as modified by this Seventh Supplemental Contract all the terms, agreements, conditions and convenants contained in the aforesaid Sixth Supplemental Contract and the aforesaid franchise ordinance shall remain and continue in full force and effect and the same shall be in dffect until the cancellation of this contract in the manner set out above. It is specificially agreed by the parties that none of the provisions of said bus franchise contract are in any way changed or modified except as to Paragraph (2) and Paragraph (4) as herein set out. 900 SECTION 2 That Robert C. Cherry, Mayor, or if he being absent, George Jacobs, Mayor Protem, be and they are hereby authorized and empowered for and on behalf of the City of Paducah, to enter into a contract containing the aforesaid amendments, said contract to be referred to as the Seventh Supplemental Contract, and to be effective August 31, 1952. SECTION 3 All ordinance and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 4 This ordinance shall be in full force and effect from and after its adoption.
