HomeMy WebLinkAboutOrdinances Book 12, Page 894, No Ordinance Number89+ AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COMMISSION RESPECTING THE SUBDIVISION OF PROPERTY OF MIDWEST MORTGAGE COMPANY ADJACENT TO THE RESERVOIR PROPERTY OF THE PADUCAH WATER WORKS, APPROVING THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1 That a resolution adopted by the Paducah Planning and Zoning Commission of August 14, 1952, entitled: I1 A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF MIDWEST MORTGAGE COMPANY ADJACENT TO THE RESERVOIR PROPERTY OF THE PADUCAH WATER WORKS i1, be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2 That the subdivision of property located in the City of Paducah and described as follows: "Beginning at a point in the southerly line of the Georgia Mae Nelson tract, said point being S64 -38E 180.01 from a concrete marker in the east right of way line of Lovelaceville Road (U. S. Highway 45) which is the southwest corner of the Georgia Mae Nelson tract and lies approximately 1075.0? south of Berger Road; and running thence S64 -38E 857.111 to a concrete marker; thence south 16-5917 133.8? to a concrete marker; thence 573-26E 732.01 to a concrete marker; thence 55-55-5017 948.291' to a concrete marker; thence S18-31-5417 275.00t to a concrete marker; thence N61-4317 49.30t to a concrete marker; thence S03 -39W 1064.647 to a concrete marker; thence N84 -22-04W 681.522 to a concrete marker; thence N 75-52-32W 250.831 to a concrete marker; thence S15 -41-47W 531.471 to a concrete marker; thence N 61-31-2317 158.68? to a concrete marker; thence S15-13-2317 96.001 to a concrete marker; thence 551-18-4017 237.261 to an iron pipe; thence N27-0617 1233.881 to a concrete marker; thence N65 -38E 1010.411 to a concrete marker in the easterly line of Highland Boulevard, formerly known as the Paducah Water Works Access Road; thence with said line of Highland Boulevard N27-2617 850.591 to a concrete post; thence N27 -32W 38.421 to a concrete post; thence N1-3917 206.10, to an iron pipe; thence N67 -57E 488.72? to an iron pipe; N36 -09W 529.681 to a concrete marker; thence N26 -38-35E 430.172 to the point of beginriing. as shown on the plat prepared by Miller, Wihry and Stout and entitled "Plat of Forest Hills1t, which said plat has been approved the the Paducah Planning and Zoning Commission, subject to such changes as may be necessary at a later date by reason of engineering difficulties which cannot at this time be resolved, and which said plat bears the signature and acknowledgement of the Chairman of the said Commission, dated August 14, 1952, evidencing such approval, be, and it is hereby, approved, and said property is hereby declared to be subdivided as shown on said plat, and subject to the following conditions: (a) As soon as possible after development of the subdivision has proceded to the point where, as a matter of good engineering practice, an accurate determination of the location of street lines may be made, a revised plat showing such street lines, street line measurements, related monuments and markers and other appropriate data will be prepared ih conformance with the t1Subdivision Ordinancell and will be submitted to the Paducah Planning and Zoning Commission and to the Board of Commissioners of 89; the City of Paducah for approval, and, after such approval is obtained, will promptly thereafter be recorded in the office of the Clerk of the McCracken County Court. (b) Any change in the location of streets in said subdivision from the location shown on said plat will be only to the extent necessary as an engineering accomodation, will be materially affect the layout as hereby approved and in any event will not affect building line distances and clearances. by more than five (5/1.) percent. (c) The action of this Board in the adoption of this ordinance and the recording of the plat hereby approved shall not constitute final acceptance or dedication of the streets shown on said plat, it being contemplated that such dedication and acceptance will be accomplished after the plat referred to in (a) above has been prepared and approved, as provided herein. SECTION 3 That the Building Inspector be, and he is hereby authorized to issue building permits for erection of improvements in said subdivision prior to the recording of the revised plat referred to in Section 2 (a) above, relying in that connection on the certification of the contractor that such improvements will be located in conformance with a Neighborhood Development Unit plan lawfully approved and that upon final dedication and acceptance of streets the building line distances and clearances will not vary more than five (5%) percent from those shown in the said Neighborhood Development Unit plan. SECTION 4 That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provisions hereof separable from all other sections, paragraphs and provisions, so that if any section, paragraph or provision hereof shall be found to be invalid, inoperative or ineffective, the deficiency or invalidity thereof shall not affect any other section, paragraph or provision hereof. SECTION 5 This ordinance shall be in full force and effect from and after its adoption.
