HomeMy WebLinkAboutOrdinances Book 12, Page 654, No Ordinance Number65 / AN ORDINANCE PROVIDING FOR THE CLOSING OF A PUBLIC ALLEY EXTENDING A UNIFORM WIDTH OF FIFTEEN (15) FEET IN A WESTERLY DIRECTION FROM A POINT ONE HUNDRED AND SIXTY-EIGHT (168) FEET WEST OF THE WEST LINE OF TWENTY-NINTH STREET BETWEEN JACKSON STREET AND CLINTON COURT, A DISTANCE OF THREE HUNDRED AND FIFTY-SIX (356) FEET, MORE OR LESS, AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN McCRACKEN CIRCUIT COURT A SUIT FOR THE PURPOSE OF HAVING SAID ALLEY LEGALLY CLOSED BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of all of that fifteen (15) foot public alley extending in a westerly direction from a point one Hundred and sixty-eight (168) feet west of the west line of 29th Street for a distance of three hundred fifty -sox (356) feet, more or less, which alley is located in the block between Jackson Street and Clinton Court, and is more particularly described as follows: Beginning at a point that lies in the south line of a 15 foot alley that runs parallel to Jackson Street on the north side thereof and 135 feet distant therefroT, said point being 168 feet from 29th street when measured on a line parallel to Jackson Street; thence in a northerly direction parallel to 29th Street 15 feet or more to the northerly side of said 15 foot alley; thence with the nor- therly side of said 15 foot alley in a west- erly direction a distance of 356 feet more or less, to the easterly side of a 25 foot alley that runs parallel and adjacent to the P&I Railroad right-of-way; thence toward Jackson Street with the line of said 25 foot alley 16 feet or more to the southerly line of said 15 foot alley; thence with the sou- therly line of said 15 foot alley 351 feet, more or less, to the point of beginning. Said alley being located entirely within the land conveyed to Maxine R. Pilley by Henry E*Weil by deed dated January 15, 1952, and recorded in I)eed Book 314, page 399, McCracken County Court Clerk's Office. And said alley being a part of the property quitclaimed to Henry E. Weil by R. L. McNatt, et al (anther abutting landowners), by deed dated November 26, 1951, and recorded in Deed Book 312, page 324, McCracken County Court Clerk's Office. SECTION 2. The Corporation Counsel of the City of Paducah is hereby authorized and empowered to institute, pursuant to provisions of KRS 93.360, a suit for decree ordering the closing of said alley. SECTION J.
