HomeMy WebLinkAboutOrdinances Book 12, Page 610, No Ordinance Number6�0 AN ORDINANCE PROVIDING FOR ,THE CLOSING OF A PORTION OF A PUBLIC ALLEY BETWEEN BROADWAY AND KENTUCKY AVENUE, WHICH PORTION BEGINS AT A POINT 160 FEET 2 3/4 INCHES WEST OF THE WEST LINE OF TENTH STREET AND MURRELL BOULEVARD AND EXTENDS IN A WESTERLY DIRECTION, A UNIFORM WIDTH OF 16 FEET FOR A DISTANCE OF 107 FEET 2 2/7 INCHES AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN THE McCRACKEN CIRCUIT COURT A SUIT FOR THE PURPOSE OF HAVING SAID ALLEY LEGALLY CLOSED BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of all of that 16 foot public alley between Broadway and Kentucky Avenue beginning 160 feet 2 3/4 inches west of the west line of Tenth Street or Murrell Boulevard and extending in a westerly direction of a uniform width of 16 feet for a distance of 107 feet 2 2/7 inches which is more particularly described as follows to -wit: Beginning at a point at the northeast corner of a tract of land conveyed to H. R. Owen by Wells Heath and pthers by deed dated January 25, 1950, and recorded in Deed Book 2$4, page 293, in the McCracken County Court Clerks office which point is 160 feet a 3/4 inches west of the west line of Tenth Street or Murrell Poulevard and 165 feet more or less north of the north line of Kentucky Avenue and in line of Nahm lot (now Fergarson); thence in a northerly direction toward Broadway Street and along the line of what was formerly known as the Nahm lot (now Fergerson) for a distance of 16 feet more or less to the southeast corner of a lot now owned by H. R. Owen; thence at a right angle and in a westerly direction along the north line of the alley and the south line of H. R. Owen and parallel with Broadway a distance of 107 feet 2 2/7 inches to the south- west corner of a lot now owned by H. R. Owen; thence at a right angle and in a southerly direction toward Kentucky Avenue a distance of 16 feet more or less to the south line of the alley and the north line of the tract of land conveyed to H. R. Ewem by Wells Heath as aforesaid; thence at a right angle and in an easterly direction parallel with Broadway and Kentucky Avenue and along the south line of said alley and the north line of said property conveyed to H. R. Owen as aforesaid a distance of 107 feet and 2 2/7 inches more or less to the beginning. SECTION 2. T,he.Corporation Counsel of the City of Paducah is hereby author- ized, empowered and directed to institute, pursuant to the provisions of of KRS 93.360, a suit for a decree ordering the closing of the said portion of said alley. SECTION 3. This ordinance shall be in full force and effect .fr om and after its adoption.
