HomeMy WebLinkAboutOrdinances Book 12, Page 562, No Ordinance NumberAN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT CERTAIN EASEMENTS AND RIGHT OF ENTRY AGREEMENTS FOR SEWER PURPOSES FROM THE PADUCAH BASEBALL ASSOCIATION, A CORPORATION, AND GEORGE BAILEY KENTUCKY: BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, SECTION 1. That the City Manager is hereby directed to accept on behalf of the City of Paducah an easement from the Paducah Baseball Association, a Cor- poration, for building and maintaining a story sewer and outlet ditch over the fol owing described property: "Beginning at a point in the east property line of "C" street 1$9.14' south of the southeast corner of the intersection of Twenty-second street and "C" street; thence in an easterly direction and along Bailey and Metzger's south line said line being also the north line of the Paducah Baseball Park Association a dist- ance of 1132' more or less to the center of Cross Creek; thence in a southerly direction and with the center of said Creek 21" more or less to a point 20' from and at right angles to Metzger's south line; thence in a westerly directio n 20' from and parallel with the line dividing the property of Metzger and the Paducah Baseball Park Association a distance of 412.0' more or less; thence at right angles northwardly 5'; thence at right angles and in a westerly direction 15' from and parallel with the line dividing the properties of Bailey and Metzger and the Paducah Baseball Park Association a distance of 346.0' to the tenter line of "B" street, if extended; thence in a northerly direction and with the center line of "B" street, if extended 51; thence in a westerly direction 10' from and parallel with the line dividing the property of Bailey and the Paducah Baseball Park Association a distance of 366' to the east property line of "C" street; thence in a northerly direction and with the east property line of "C" street 10' to the point of beginning." The consideration for this easement shall be the mutual benefit to both the City and the Association. SECTION 2. That the City Manager, in connection with the same sewer and. ditbh construction mentioned.in Section 1 aforesaid, is further directed to accept on behalf of the City of Paducah, and without cost to it, from George T. Bailey a right of entry and permission to cut or trim trees obstructing the construction of said sewer over the following property: "Beginning at a point on the east property line of "C" Street 160' south of the southeast corner of the intersection of "C" street and Twenty-second street; thence in an easterly direction parallel with Twenty- second street 4$0.01' to Metzger's west line; thence with Metzger's west line in a southerly direction 22.96' to the north line of the Paducah Baseball Park Association; thence in a westerly direction and with the north line of the Paducah Baseball Park Association 480.03' to the east property line of "C" street; thence in a northerly direction and with th4 east property line of "C" street a distance of 29.14' to the point of beginning." SECTION 3. This ordinance shall be in full force and effect from and after its adoption.
