HomeMy WebLinkAboutOrdinances Book 12, Page 548, No Ordinance NumberAN ORDINANCE AMENDING SECTION 1 OF AN ORDINANCE ENTITLED: "AN ORDINANCE PROVIDING FOR THE CLOSING OF THAT PART OF HARRIS STREET EXTENDING FROM THE NORTH LINE OF NORTH EIGHTH STREET TO THE SOUTH LINE OF NORTH SEVENTH STREET; AN ALLEY 30 FEET IN WIDTH EXTENDING FROM THE WEST LINE OF HARRIS STREET TO THE EAST LINE OF BOYD STREET BETWEEN NORTH SEVENTH AND NORTH EIGHTH STREETS; AND ANY OTHER STREET, ALLEY OR PUBLIC WAY WITHIN THAT AREA COMPRISING WHAT IS KNOWN AS PROJECT KY 6-4 OF THE PADUCAH MUNICIPAL HOUSING COMMISSION, AS SAID STREETS, ALLEYS AND PUBLIC W ARE SHOWN ON A PLAT OF SAID PROJECT; AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN THE McCRACKEN CIRCUIT COURT A SUIT TO CLOSE SAID STREETS, ALLEYS AND OTHER PUBLIC WAYS BY ORDER OF COURT", WHICH WAS ADOPTED BY THE BOARD OF COMMISSIO ON OCTOBER 16, 1951 BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 1 of an ordinance containing the title quoted above, which was adopted by the Board of Commissioners on October 16, 1951, be and the same is hereby repeale d, amended and reordained so that said Section as amended and reordained shall read as follows: "Section 1. That the City of Paducah, in order to provide the Paducah Municipa Housing Commission with the land necessary for the construction of a new housing project known as Project KY 6-4 without interference by the members of the traveling public using the streets, alleys and public ways now extending over and through the site that.has been selected and purchased by said Commission, and to enable said Commission to construct building units on said project site according to plans there for, does hereby authorize the closing of all of that part of Harris street which extends from the north line of North Eighth Street to the South line of North Sevent; Street through said project, and also an alley 30 feet in width lying between North Eighth Street and North Seventh Street extending from the west line of Harris Street to the East line of Boyd Street, and any other street, alley or public way within th, area known as Project KY 6-4 of the Paducah Municipal Housing Commission as same are shown on a plat of said project, and which streets, alleys and public ways to be closed hereby being more partifularly described as follows: "All that portion of Harris Street in said area and beginning at the northeast corner of the inter- section of Harris and $Sh streets; thence north along the east property line of Harris street 425 feet to the southeast corner of the intersection of Harris and North 7th street; thence west and along the south property line of north 7th street 60 feet to the southwest corner of the intersection of Harris and North 7th street; thence 8n a southerly direction along the west property line of Harris street 425 feet to the northwest corner of the inter- section of Harris and 8th street; thence in an east- grly direction along the north line of 8th street 0 feet to the point of beginning." t 549 "All that part of a 30 foot alley lying between Harris and Boyd streets and North 8th and North 7th streets, beginning at a point in the west line of Harris street 197.5 feet north of the northwest corner of the inter- section of Harris and North 8th streets; thence in a westerly direction parallel with North 8th street 400 feet to the east line of Boyd street; thence in a northerly direction and with the east line of Boyd street 30 feet to a point; thence in an easterly direction and parallel with North 8th street 400 feet to a point in the west line of Harris street; thence in a southerly direction along the west line of Harris street 30 feet to the point of beginning." Thare is specifically retained, however, by the City of Paducah a right of entry and easement over and on a part of said Harris street comprising ten (10 feet on each side of the center line of said street extending from North 8th street to North 7th street, said easement being for the purpose of impnoving, repairing or replacing a sewer line now located, or to be located, along said Harris street, and the Corporation Counsel is hereby authorized and directed to institute a suit in the McCracken Circuit Court pursuant to the provisions of KRS 94.360 for the purpose of carrying the provisions of this ordinance into effect." SECTION 2. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
