HomeMy WebLinkAboutOrdinances Book 12, Page 524, No Ordinance Number524 AN ORDINANCE APPROVING THE ACTION OF THE CITY PLANNING AND ZONING COMD4ISSION RESPECTING THE RESUBDIVISION OF THE PROPERTY KNOWN AS "CAVE HILL SUBDIVISION", APPROVING THE PLAT SHOWING SAID RESUBDIVISION AND RESUBDIVIDING SAID PROPERTY WHEREAS by ordinance entitled "AN ORDINANCE APPROVING THE: YiNAL xeruxr OF THE CITY PLANNING AND ZONING COMM..ISSION RESPECTING THE SUBDIVISION OF THE PROPERTY OF E. A. CAVE AND SON, WHICH ABUTS THIRTY-NINTH STREET (EXTENDED) BETWEEN SUNSET AVENUE AND THE BLANDVILLE ROAD, APPROVING THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY", adopted by this Board od July 10, 1951, the subdivision of property inown as "Cave Hill Subdivision" was approved as shown by a plat now of record in Plat Book D, page 43, in the office of the Clerk of the McCracken County Court, and WHEREAS by resolution entitled: "A RESOLUTION RESPECTING THE RESUBDIVISION OF THE PROPERTY KNOWN AS 'CAVE HILL SUBDIVISION", the City Planning and Zoning Commission has approved the resubdivision of said property as shown by the plat referred to hereinafter, and WHEREAS it appears that such resubdivision is necessary to correct certain technical errors in the original plat, none of which is of material consequence or affects the general plan or layout of the original subdivision, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION I. That the aforesaid resolution, and the action of the City Planning and Zoning Commission as reflected therein, be, and they are hereby approved. SECTION II That the resubdivision of said property, as shorn by the plat prepared by E. C. Bowman, Surveyor, and entitled "Cave Hill Subdivision, Paducah, Kentucky", which said plat has been approved by the City Planning and Zoning Commission, as is evidenced by the signatures and acknowledgements of the Chairman of said Commission and the City Engineer dated September 5, 1951, be, and it is hereby, approved, and said property is hereby declared to be resubdivided as shown on said plat. SECTION III That the original plat of subdivision of Record in Plat Book D, page 43, as aforesaid, is now cancelled, voided and superseded. SECTION IV That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or in- validity of such section, paragraph or provision shall not affect- any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions, so that if any section, paragraph or provision hereof shall be found to be invalid, inoperative 525 or ineffective, the deficiency or invalidity thereof shall not affect any other section, paragraph or provision hereof. SECTION V That this ordinance shall be in full force and effect from and after the date of which the aforesaid plat of resubdivision is lodged for record in the office of the Clerk of the 14cCracken County Court.
