HomeMy WebLinkAboutOrdinances Book 12, Page 519, No Ordinance Number51 AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION RESPECTING THE SUBDIVISION OF THE PROPERTY OF GUTHRIE MAY LYING EAST OF CORNELL PLACE AND WEST OF MAYFIELD ROAD BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the City Planning and Zoning Commission on September 7, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY PLANNING AND ZONING C014"ISSION ON THE PROPOSED SUBDIVISION OF THE PROPERTY OF GUTHRIE MAY LYING EAST OF CORNELL PLACE AND LEST OF MAYFIELD ROAD", be approved as the final report of said Commission respecting the matters therein set forth. SECTIO17 2. That the subdivision of property located in the City of Paducah and described as follows: "Commencing at the northeast corner of Cornell. Place as recorded; thence south 7$042'45" east along the south line of Schmidt street 245.76 feet; thence south 10041'00" west 335.3 feet; thence eastwardly on a 28.650 curve to the right a distance of 69.96 feet; thence south 70051' east 212.83 feet to the west line of Mayfield Road; thence south 19006' west 50'; thence north 70051' west 212.83 feet to the point of curvature of a 38.20 curve to the left; thence along said curve to the left a distance of 111.34' to the end of said curve; thence south 66037' west 110.04 feet - thence south 10041.'00" west 36.62 feet; thence south 706 51' east 211.74 feet; thence south 19006' west 134.0$ feet; thence north 78048' west 24.74 feet; thence south 19 06' west 266.49 feet; thence north 79021' west 303.43 feet; thence north 10041100" east 3.15.6.feet• thence north 860 29'30" east 45.11 fee8; thence north 8634100" east 235.0 feet; thence north 65 15130" west 36.03 feet; thence north 100411001,!"east feet; thence north 72041'00" east 67.5 feet-; thence nortF 12028'15" east 114.66 feet to the place of beginning." As shown by the plat prepared by Charles E. Day, Surveyor, and entitled "Cornell Place No. 211, which said plat has been approved by the City Planning and Zoning Commission and bears the signatures and acknow- jedgements of the Chairman of said Commission and the City Engineer, dated_, 1951, be and it is hereby, approved, and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That strict compliance with the provisions of an ordinance entitled: "AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING C01.11•ISSION ESTABLISHING RULES AND REGULATIONS RELATING TO THE LAYING OUT, SUBDIVIDING AND PLATTING OF LANDS WITHIN THE CITY OF PADUCAH AND 14ITHIN THREE MILES OF THE CITY LIMITS, ADOPTING SAID RULES AND REGULATIONS RECOMb".ENDED IN THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION, AND PRESCRIBING THE PENALTY TO BE IMPOSED FOR THE VIOLATION OF THE RULES AND REGULATIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING COMMISSION ON MARCH 26, 1945", which was adopted by the Board of Commissioners on March 27, 1945, would impose an undue hardship upon the owner of said property, and such provisions, to the extent hereinafter indicated, are hereby waived. 520 SECTION 4. That in lieu of placing stones, markers and monuments on said property and certifying such placement on said plat, the surveyor and the owner of said propert may certify on said plat that within a period of one (1) year from the adoption of this ordinance they will place said stones, markers and monuments as shown on said plat, provided, however, that as a condition to this authorization said owner shall furnish bond with good and sufficient surety in the amount of $ , which said bond shall be in words and figures as follows: "KNOW ALL MEN BY THESE PRESENTS: That we, Guthrie May, of Evansville, Indiana, as principal (hereinafter called 'Principal') and , as Surety, (hereinafter called 'Surety') are held and firmly bound unto the City of Paducah, Kentucky, as obligee (hereinafter called 'Obligee') in the penal sum of 0 ) Dollars, for the payment whereof, well and truly to be made, we do hereby bind ourselves, our heirs, executors, administrators, successors and assigns jointly and severally, firmly by these presents. Now the condition of the bond is such that the said principal is the owner of a tract of land in Paducah, Kentucky, known as Cornell Place No. 2, a plat of which has been, or will be, lodged for record in the office of the Clerk of McCracken County, and said plat bears the certification of the said Principal that all stones, markers and monuments shown on said plat will be placed on said property in conformity with said plat. Now; if the said Principal places said stones, markers and monuments on said property in strict conformity with said plat by September 11, 1952, then this obligation shall be void; otherwise to remain in full force and effect. IN TESTIMONY WHEREOF, Guthrie May as Principal and as Surety, have hereunto set their names this the day of ---- 1951. Guthrie May, Principal Surety" SECTION 5. That if any section, paragraph or provision of this ordinance shall be .found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section., paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof W separable from all other sections, paragraphs and provisions, so that if any section, paragraph or provision hereof shall be found to be invalid, inoperative or ineffective, the deficiency or invalidity thereof shall not affect any other section, paragraph or provision hereof. SECTION 6. That this ordinance shall be in full .force and effect from and after the date on which the aforesaid plat is lodged for record in the office of the Clerk of the McCracken County Court. s'iayor Pro Tem ' C.
