S 5 AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING C0R11ISSION RESPECTING THE ZONING OF THE PROPERTY ABUTTING THIRTY-NINTH STREET (EXTENDED) BETWEEN SUNSET AVENUE (EXTENDED) AND THE BLANDVILLE ROAD, MAKING SAID PROPERTY SUBJECT TO CERTAIN RESTRICTIONS AND FIXING PENALTIES FOR VIOLATIONS OF� SUCH RESTRICTIONS BE IT ORDAINED BY THE BOARD OF COPTIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: (C - SECTION 1. That a resolution adopted by the City Planning and Zoning M Commission on June 15, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT M OF THE CITY PLANNING AND ZONING COMv!ISSION ON THE PROPOSED ZONING OF THE PROPERTY ABUTTING THIRTY-NINTH STREET, EXTENDED, BETWEEN SUNSET AVENUE, EXTENDED, AND THE BLANDVILLE ROAD", be approved as the final report of said Commission respecting the matters therein set forth. SECTiION 2. That the property abutting Thirty-ninth Street, extended, betwe Sunset Avenue, extended, and the Blandville Road, be and it is hereby, zoned for residential purposes only and shall be subject to the following restrictions: a. All lots in the tract referred to above shall be used and maintained for residential purposes only, and no structure shall be erected, altered or placed on any such lot other than one detached single-family dwelling, not to exceed two stories in height, and a private garage for not more than 2 automobiles. b. Residences on lots abutting the Blandville Road shall front the Blandville Road. Residences on all other lots shall front 39th street (extended). c. The ground floAr square foot area of any residential structure exclusive of one story porches and garages, shall not be less than 1250 square feet in the case of houses fronting the Blandville Road, and not less than 1000 square feet in the case of houses fronting 39th street (extended). d. No structure shall be placed on the property closer than 55 feet to the Blandville Road, closer than 40 feet to 39th street (extended), closer than 15 feet to Sunset Avenue (extended), closer than 15 feet to the rear lot lines or closer than 5 feet to the side lines which divide the lots. e. No fence higher than 42 inches shall be placed on the property, nor shall it be built closer to 39th street and Blandville Road then the front building lines. f. No noxious or offensive activity shall be carried on or per- mitted upon any lot, nor shall anything be done thereon which may be or may become, an annoyance or nuisance to the inhabitants in the vicinity or to the public generally. g. No trailer, basement, tent, shack, garage, barn or other outbuilding on said property shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted. SECTION 3. That any property owner, tenant or other person, firm or corporation who erects, constructs or reconstructs any building in violation of, or contrary to), the provisions of this ordinance, or who breaches or violates any provision of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than Ten (u10.00) Dollars 436 nor more than One Hundred (';100.00) Dollars for each offense so committed, and any person so offending or so guilty of a violation of the provisions hereof, may, in addition to such fine, be imprisoned not mpre than fifty (50) days at the discretion of the Judge or Jury trying the case, and in the event the offense or violation is a continuing one, extending from one day until the next, a separate offense or violation shall be deemed to have been committed on each day involved and shall be subject to a separate penalty under the provisions hereof. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions, so that if any -section, paragraph or provision hereof shall be found to be invalid, inoperativ or ineffective, the deficiency or invalidity thereof shall not affect any other section, paragraph or provision hereof.
