HomeMy WebLinkAboutOrdinances Book 12, Page 394, No Ordinance Number3941 AN ORDINANCE PROVIDING FOR THE REMOVAL OF CERTAIN HOUSES ON THE WHITE VETERAN'c PROJECT KY -V-15-140 TO THE RHODES-BRPADY COURT, THE COLORED VETERAN'S HOUSING PROJECT LOCATED AT 11TH & FLOURNOY STREETS IN PADUCAH, KENTUCKY, FOR RENTAL TO TENANTS WHOSE REMOVAL FROM THE SITE SELECTED FOR THE CONSTRUCTION OF THE NEW COLORED HOUSING PROJECT AT EIGHTH AND BOYD STREETS IS REQUIRED; AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR AND RECEIVE BIDS OF CONTRACTORS FOR THE REMOVAL OF SAID BUILDINGS, AND PRESCRIBING THE TERMS AND CONDITIONS UPON ['WHICH SUCH BUILDINGS SHALL BE REMOVED; APPROPRIATING A SUM NOT EXCEEDING ,4,500 TO COVER THE COST OF REMOVING THE AFORESAID BUILDINGS PURSUANT TO THE TERNS OF THIS ORDINANCE, SAID EXPENSE TO BE CHARGED TO ACCOUNT NO. 7900, HOUSING REMOVAL FUND, TO BE CREATED UNDE THE ANNUAL APPORTIONMENT ORDINANCE BY THE AMENDMENT OF SAID ORDINANCE; AND PRO- VIDING FOR THE APPOINTMENT OF THE CITY OF PADUCAH MUNICIPAL HOUSING CPP14ISSION TO ACT AS THE FISCAL AGENT OF THE CITY OF PADUCAH TO MANAGE AND CONTROL SAID RENTAL PROPERTIES AFTER THE 31M1E HAVE BEEN REMOVED FROM THE VETERAN'S VILLAGE SITE; AND PRESCRIBING THE TERMS AND CONDITIONS UNDER 1H ICH THE CITY OF PADUCAH MUNICIPAL HOUSING COM4MISSION SHALL MANAGE RND OPERATE AND CONTROL SAID TEMPORARY RENTAL PROJECT. WHEREAS, the construction of a new housing project for colored persons at 8th and Boyd Streets in Paducah, Kentucky, will require a number of colored familie to move from the residences they now occupy on the site selected for the construc- tion of said project, and it is deemed advisable to remove seven (7) of the build- ings located upon the Veteran's Housing Project, Ky-V-15-140, to the Rhodes -Broady Court to provide residences for those families which are required to vacate their homes on the site of the new colored holsing project; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the removal of buildings Nos. "A", "B", "C", "E", "G", "H", and "I" located upon the Veteran's Housing Project, Ky-V-15-140, as said buildings are so designated and shown upon the plat of the Paducah Municipal Housing Project No. Ky-6-3, which plat is filed herewith and as a part of this ordinance, to the Rhodes -Broady Court at 11th and Flournoy Streets, for the purpose of affording temporary residences for those families who ate required to vacate their homes on the site of the new colored housing Project at 8th and Boyd Streets in the City of Paducah, Kentucky. SECTION 2. The City Manager is hereby authorized and empowered for and on behalf of the City of Paducah, to advertise for bids pf contractors to remove and relocate the aforesaid seven (7) buildings pursuant to the provisions of this ordinance. He shall advertise for bids by posting a notice at the City Hall door and by inserting a notice of the request for bids in at least one (1) issue of the Sun -Democrat, the notice shall be posted and published at least seven (7) 0 0 395 days prior, to the opening of bids and no bid shall be opened within ten (10) days from the date on which this ordinance is adopted. No bid shall be received after the hour fixed in the notice for the opening of bids. All bids received by the City Manager up to the time fixed in the notice for the opening of bids shall be filed with the Board of Commissioners who may let the contract for the removal of said buildings to the lowest responsible bidder or bidders. The right shall be reserved to reject any and all bids and the City shall not be obligated under a contract until the adoption of an ordinance authorizing its execution. SECTION 3. There is hereby appropriated the sum of not exceeding ~;4,500 to cover the cost of removing the aforesaid buildings and for providing such facilities as shall, in the judgment of the City Manager, be necessary to make the same tenantable, the amount so appropriated to be charged to an account number designated as Account 7900 to be provided for under an amendment of the 1951 Apportionment Ordinance. SECTION 4. That the City of Paducah Yunicipal Housing Commission be and it is hereby designated to act as Fiscal Agent of the City of Paducah for the selection of tenants, establishment of rent schedules and for the general super- vision and management of said tenporary housing project on the Rhodes -Broady Court, and the Mayor is hereby authorized and empowered to enter into an agreement with the City of Paducah Municipal Housing Commission for the purpose of fixing the terms and conditions under which said Commission shall maintain and operate said project,collect the rents therefrom and remit same to the City of Paducah, said agreement to be in form and substance the same as that agreement under which the City of Paducah Municipal Housing Commission heretofore operated the Veteran's Housing Project, Ky-V-14-140, and that said agreement when executed be received and .filed as a part of -the official records of the City of Paducah. SECTION 5. All ordinances and parts of ordinances in conflict herewith are to the extent of suct conflict, hereby repealed. SECTION 6. This ordinance shall be introduced at a regular meeting of the Board of Commissioners and remain on file for public inspection for at least one week in the completed form in which it shall be put upon its final passage. As it is immediately necessary to provide housing accommodations for those persons who are required to vacate because of the construction of the aforesaid new colored project, the public health and safety require that this ordinance be made immediate] effective, an emergency is accordingly declared and this ordinance shall be in full force and effect from and after its adoption. n r.iayor Introduced by the Board of Commissioners Kay 2`9, 1951.
