HomeMy WebLinkAboutOrdinances Book 12, Page 382, No Resolution Number382 RESOLUTION APPROVING THE RULES AND REGULATIONS OF THE PADUCAH WATER WORKS, MUNICIPALLY OWNED: WHEREAS, THE COMMISSIONERS OF WATER WORKS OF THE PADUCAH WATER WORKS HAVE RECOMMENDED TO THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH THE ADOPTION OF CERTAIN RULES AND REGULATIONS WHICH ARE HEREINAFTER SET OUT PERTAINING TO WATER MAIN EXTENSIONS WITHIN THE CITY LIMITS OF PADUCAH, KENTUCKY, AND WHEREAS, IT IS DEEMED TO BE IN THE BEST INTEREST IN THE OPERATION AND MANAGEMENT OF SAID PADUCAH WATER WORKS THAT SAID RULES AND REGULATIONS AS RECOMiMEN- DED BE ADOPTED, THEREFORE, BE IT RESOLVED THAT THE FOLLOWING RULES AND REGULATIONS BE APPROVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH FOR THE MANAGEMENT AND OPERATION OF WATER MAIN EXTENSIONS OF THE PADUCAH WATER WORKS, THE SAME TO BE IN FULL FORCE AND EFFECT FROM AND AFTER THIS DATE. RULES AND REGULATIONS ---WATER MAIN EXTENSIONS---PADUCAH WATER WORKS, MUNICIPALLY OWNED 1. Water mains will be extended within the city limits without charge for q distance of fifty (50) feet from present main locations for each actual consumer. Such extensions shall be made upon the petition of each actual consumer who shall apply for and contract to use water for two (2) years or more. 2. In the case of extensions in excess of fifty (50) feet, undeveloped area and vacant lots, the owner or interested parties are required to deposit with the Water Works the estimated cost of construction of the main extension based upon the cost of a six inch main, excluding street intersections. Upon the completion of th installation of the extension requested, the Water Works will furnish the depositor a statement showing the actual cost of the installation. In the event the actual cost is less than the amount deposited, the Water Works will return to thh deposito , without interest, the difference between the amount deposited and the actual cost. In the event the actual cost of the installation exceeds the amount deposited with the Water Works, the depositor shall make a further deposit with the (dater Works of the difference between the actual cost and the amount deposited. 3. The extension will be inspected on or about the first day of January and the first day of July of each year and a refund to the original depositor of the cost of fifty (50) feet of six inch main will be made for each metered connection not previously refunded. In no event shall the refunds exce&d the actual cost of the extension and such refunds can be earned for a period of ten (10) years from the date of the completion of the work. 4. The size of mains to be used in the construction of extensions shall be determined by the Paducah Water Works. In the event the Water Works determines tha a main larger than six inches is necessary then the Water Works will pay the difference between the actual cost pf the six inch main and the larger main. 5. Whenever the Water Works shall determine that it would be to the best interests of its water distribution system to construct a water main extension the Water Works may, with the approval of the Board of Commissioners of the City of Paducah:, construct such extension without the filing of any petition or with- out the making of any advance payments or deposits. 6. All water mains laid as herein provided for shall be laid with the approval of the Board of Commissioners of the City of Paducah and shall become the property of the Paducah Water Works and such Water Works shall have the ex- clusive right to make further extensions and connect consumers thereto.
