HomeMy WebLinkAboutOrdinances Book 12, Page 381, No Ordinance NumberAN AN ORDINANCE PROVIDING FOR THE PAYMENT OF TWENTY-FIVE (5,25.00) DOLLARS TO KELLY LEE FRANKLIN AND WIFE, RUBY MARIE FRANKLIN FOR A PERMANENT RIGHT OF WAY EASEMENT OVER CERTAIN REAL ESTATE LOCATED AT OR NEAR STATION 217/30 OF THE FLOODPLALL RIGHT OF WAY LINE TO BE USED IN CONNECTION WITH THE CONSTRUCTION AND REPAIR OF THE FLOOD - WALL; PRESCRIBING THE TERI-IS AND CONDITIONS OF SAID EASEMENT AIS AUTHORIZING ACCEPTANCE THEREOF BE IT ORDAINOD BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah purchase from Kelly Lee Franklin and his wif , Ruby Marie Franklin, for the sum of Twenty-five ($25.00) Dollars upon certification by the Corporation Counsel that said parti6s hold a good marketable title to the hereinafter described property and upon execution and delivery by said parties of an instrument in writing conveying to the City of Paducah a permanent right of way easement for the construction and repair of the floodwall to the City of Paducah at or near Station 217/30 over and on the following described property, to -wit: "Beginning at a point on the west right of way line of the Paducah Floodwall, said point being located opposite and at right angles to Station 217/30 and 160.2 feet north pf the north property line of Cook Street; thence at right angles to said right of way line in a westerly direction 10 feet; thence at right angles in a northerly direction and parallel with the right of way line of the Floodwall 14.4 feet to the south right of way line of the Illinois Central Railroad; thence in a southeasterly direction and with the railroad right of way 11.3 feet to the right of way line of the Flood - wall; thence with said Floodwall right of way in a southerly direction 9.2 feet to the point of beginning." Being a part of the same property conveyed to Kelly Lee Franklin by deed from Delilah Franklin Reid and others dated September 16, 1947, and of record in Deed Book 261, page 23LE, McCracken County Court Clerk's Office. SECTION 2. The sum of Twenty-five (N25.00) Dollars to be paid for the aforesaid easement shall be charged to Account Number 1288 and the City Manager and the City Treasurer are authorized to deliver a check drawn on the general fund of the City of Paducah in said sum payable to said Kelly Lee Franklin and wife, Ruby Marie Franklin upon delivery by them to the City Manager of a properly drawn and executed instrument conveying the easement described in Section 1 to the City of Paducah.
