HomeMy WebLinkAboutOrdinances Book 12, Page 378, No Ordinance Number37V AN ORDINANCE PROVIDING FOR THE PAYMENT OF FIVE ($5.00) DOLLARS TO HOLKS JOHNSON AND HIS WIFE, LYNORA N. JOHNSON FOR AN EASEMENT OVER CERTAIN REAL ESTATE LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF 10TH AND PINE STREETS TO BE USED IN CONNECTION WITH THE CONSTRUCTION OF A DIVERSION SEWER AND ALSO FOR REPAIR AND MAINTENANCE OF THE FLOODWALL; PRESCRIBING THE TERMS AND CONDITIONS OF SAID EASEMENT AND AUTHORIZING ACCEPTANCE THEREOF BE IT ORDAINED BY THE BOARD OR COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah purchase from Hollis Johnson and his wife, Lynora N. Johnson, for the sum of Five ($5.00) Dollars, upon certification by the Corporation Counsel that said parties hold a good marketable title to the hereinafter described property and upon execution and delivery by said parties of an instrument in writing conveying to the City of Paducah an easement for the construction of a diversion sewer on Pine Street in the City of Paducah in conn- ection with the construction and maintenance of the City of Paducah Floodwall over and on the following described property, to -wit: "Beginning at the northwest corner of the intersection of the 10th and Pine Street property line; thence in a northerly direction and along the west property line of Pine Street 198.09 feet; thence at a deflection angle of 55 degrees to the left in a northwesterly direction 59.67 feet; thence at right angles in a sputhwesterly direction 60feet; thence at right angles in a southeasterly direction 83.98 feet to a point 14.50 feet from and at right angles to Pine Street; thence in a southerly direction 134.99 feet to the north property line of 10th Street, said line being 14..50 feet from and parallel to the west property line of Pine Street; thence in an easterly direction and with the north property line of 10th Street 14.50 feet to the point of beginning." Being a part of the same property conveyed to Hollis Johnson by D. B. LaSieur by deed dated February 5, 1951, in Deed Book 295, page 455 McCracken County Court Clerk's Office. SECTION 2. Also as a part of the consideration cited in Section 1 and under the terms therein set out, the City of Paducah is authorized to purchase from Hollis Johnson and wife, Lynora N. Johnson, for the purpose of sewer maintenance for said Pine Street diversion sewer a perpetual easement off of the above described tract, described as follows, to -wit: "A strip of real estate 16 feet in width, the center of which shall coincide with the center line of the sewer as built, extending from the west property line of Pine Street to a point 20 feet beyond the outlet of the sewer." SECTION 3. The sum of Five (X5.00) Dollars to be paid for the aforesaid easement shall be charged to Account Number -1288 and the City Manager and the Cit Treasurer are authorized to deliver a check drawn on the general fund of the City of Paducah in said sum payable to said Hollis Johnson and wife, Lynora N. Johnson upon delivery by them to the City Manager of properly drawn and executed instruments conveying the easements described in Sections 1 and 2 to the City of Paducah. 379 SECTION 4.
