That a resolution adopted by the City Planning and Zoning Commission on March 23, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY PLANNING AND ZOP?Ib:G COMEISaION Oii THE PROPOSED ZONING OF THE PROPERTY BOUNDED ON THE NORTH BY SCHI=.IDT STREET, ON THE VIEST BY GEORGIA STREET, ON THE SOUTH BY BEIDE ZRIAN STREET AND THs OLD MAYFIELD ROAD AND ON THE EAST BY THE SAID OLD i•?.YFIEL•D 30AD", be approved as the final report of said Commission respecting the matters therein set forth. SCTION 2. That the property bounded on the north by Schmidt Street, on the west by Georgia Street, on the south by Beiderman Street and the Old Mayfield Road and on the east by the said Old P.iayfield Road, be, and it is hereby zoned for residential purposes only and shall be subject to the following restrictions; (1) All lots in the above-mentioned tract shall be, and shall be known and described as, residential lots, to be used and maintained for residential purposes only, and no structure shall be erected, altered, placed or permitted to remain on any such lot other than one detached single- faraily dwelling not to exceed one and one-half (14) stories in height and a private garage for not more than two (2) cars. (2) No building shall be erected on any residential building lot nearer than twenty-five (25) feet to the front lotline, nor nearer than five (5) feet to any side lot line. No separate _,rage or other outbuilding shall be located nearer than fifty- five (55) feet to the front lot line or nearer than five (5) feet to any side out line All residences shall front the streets in the manner in which the lots are laid out. (3) The ground floor square foot area of any residential structure, exclusive of one story porches and garages, shall rot be less than 698 square feet-. (4) i,?o noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. (5) No trailer, basement, tent, shack, garage, barn or other outbuilding erected or placed on the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a tempora ry character be permitted. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the afore- said provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any surra not less than ,;10.00 nor more than ."100.CO for each offense so committed andeach day such offense is committed shall be deemed a separate offense and shall be subject- to a separate penalty unde the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may in addition to such fine by imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. 329 SSCTIO1' 4. If any section or provision of this ordinance shall be found to be inoperative or ineffective for any cause, the invalidity of such section or provision shall not affect any other section or provision hereof, it being the pur- pose of this ordinance to make each and every section and provision hereof separably from all other sections and provisions so that if any section or provision shall be found to be invalid, the invalidity thereof shall not affect any other portion, section or provision hereof. SECTION_2_.
