HomeMy WebLinkAboutOrdinances Book 12, Page 315, No Ordinance Number31.5/ AN ORDINANCE PROVIDING FOR THE CLOSING OF THAT PARTOF ANSPACHER AVENUE, 40 FEET IN WIDTH EXTENDING 190 FEET FROM THE NORTH LINE OF AN ALLEY WHICH RU1.3 FROM THE WEST LINE OF BURNETT STREET BETWEEN SIXTH AND EIGHTH STREETS; AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN THE MCCRACKEN CIRCUIT COURT A SUIT FOR THE CLOSING OF SAID STREET BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, subject to the conditions hereinafter provided, does hereby authorize the closing of all of that portion of Anspacher Avenue 40 feet in width extending 190 feet north from the north side of an alley which runs from the west side of Burnett Street through the block between Sixth and Eighth Streets in Paducah, Kentucky, which portion of Anspacher Avenue to be closed pursuant to the provisions of this ordinanceis more particularly described as follows: "Beginning at a point 160 feet west of the northwest corner of the intersection of Burnett Street to a 30 .foot alley extend- ing from the west line of Burnett Street into the block between Sixth and Eighth Streets in Paducah, Kentucky; thence north and at an exterior angle of $6 degrees 02 minutes 190 feet; thence west and parallel with the north line of the aforesaid alley 40 feet; thence south and at an exterior angle of 86 degrees 02 minutes 190 feet to the north line of the aforesaid alley; thence east and along the north line of said alley 40 feet to the point of beginning." And the Corporation Counsel is hereby authorized and directed to institute a suit in the McCracken Circuit Court pursuant to the provisions of KRS 93.360 for the purpose of carrying the provisions of this ordinance into effect. SECTION 2. The aforesaid street is ordered to be closed upon the condition that the pwhers of -all of the abutting property thereon shall enter into and execute an agreement releasing the city of Paducah from all liability and respon- sibility for the maintenance of the sewer line running into, under and through said street. SECTION 3. This prdinance shall be in full force and effect from and after its qdoption.
