HomeMy WebLinkAboutOrdinances Book 12, Page 266, No Ordinance Number266 AA t ED AN ORDINANCE REGULATING THE USE OF ROTOR TRUCKS, SEMI -TRAILERS AND TRAILERS IN THE CITY OF PADUCAH, KENTUCKY, AS AUTHORIZED BY AN ACT OF THE GENERAL ASSEMBLY OF THE COMMONWE@LTH OF KENTUCKY'; PROVIDING FOR SPECIAL PERMITS FOR SUCH USE AND THE ISSUANCE OF REGISTRATION CERTIFICATES AND LICENSES FOR SUCH EQUIPMENT; FIXING THE FEES THEREFOR AND REGULATING THE DISPLAY THEREOF; LIMITING THE STREETS AND PUBLIC WAYS UPON WHICH SUCH EQUIPMENT MAY OPERATE; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. As used in this ordinance: "Motor truck" means any motor propelled vehicle designed for carrying freight or merchandise. "Semi -trailer" means a vehicle designed to be attached to, and having its front end supported by, a motor truck or truck -tractor, intended for the carrying of freight or merchandise. "Trailer" means a vehicle designed to be drawn by a motor truck or truck -tractor, but supported wholly upon its own wheels, intended for the carrying of freight or merchandise. "Person" means any individual, firm, corporation, partnership, company, association, bo dy-politic, trust, fiduciary or entity. 996T2ON 2. In conformity with an Act of the General Assembly of the Commonwealth of Kentucky for further regulating motor trucks, semi -trailers, and trailers, no person shall operate on any streets or public ways of the City more than two trailers in any one unit and no combination of a truck and trailers or semi -trailers shall exceed 65 feet in length. .:. . ..SECTION 3. No person shall operate on any street or public way of the city any motor truck, semi -trailer or trailer the gross weight of which, including load, shall exceed 2,000 pounds on any wheel or 18,000 pounds on any axle. SECTION 4. No person shall operate on any street or public way of the city any motor truck, semi -trailer or trailer the height of which, including any part of body or load, shall exceed 1312 feet, but nothing herein contained shall be construed to require the public authorities of the city to provide sufficie nt vertical clearance to permit the operation of vehicles with a hei ght of 132 feet, or any height. SECTION 5. No person shall operate on any street or public way of the city any motor truck or semi -trailer the width of which, including any part of body or load, shall exceed 8 feet. SECTION 6. No person shall operate on any street or public way of the city any motor truck the length of which, including any part of body or load, shall exceed 35 feet; nor any semi -trailer, trailer or vehicle, or combination of vehicles, the length of which, including any part of bpdy or load, shall exceed 65 feet. 267 SECTION 7. No person shall operate any motor truck, semi -trailer or trailer on any street or public way of the city unless the same shall be equipped so as to conform to the laws of the Commonwealth of Kentucky. SECTION g. No person shall operate on the streets or public ways of the city a motor truck, semi -trailer or trailer which exceeds the limitations prescribed by Kentucky Revised Statutes, but which does not exceed the limitations prescribed by this ordinance unless the owner or operator of such vehicle shall first have purchased a license as herein provided. It shall be the duty of the City Treasurer to cause to be prepared suitable license or registration plates or stickers and to issue the same and a certificate of registration to the owner of every motor truck,semi-trailer or trailer who makes application therefor and who shall have paid the necessary fee provided for herein. It shall be the duty of the -owner or driver of such i equipment to display such plate or sticker at all times in a prominent place upon i his egtlipment. However, nothing in this ordinance shall require the procuring of a license or the payment of the herein prescribed fee by any person whose motor truck, semi -trailer or trailer may operate legally upon the highways pf this state under the provisions of the laws of the commonwealth of Kentucky. SECTION 9. The applicant for a license, as herein provided, shall pay to the City Treasurer the sum of v5.00 for each license plate or sticker issued to defray the cost of such registration, the necessary inspection and the enforcement of this ordinance. SECTION 10. The registration hereinabove provided for shall be for the period of one year beginning January 1 and ending December 31. ✓, SECTION 11. Motor trucks, semi -trailers or trailers having a gross 1L_ weight of over 10 tons shall be operated only on the following streets and public's ways of the city: /��' /z Bridge Street from the city limits to Broad Street; Broad � zy / Street from Sixth Street to Bridge Street and from Fourth Street to Third Street; Sixth Street from Broad Street to Kentucky Avenue; Kentucky Avenue from Sixth Street to Twenty-eighth Street; Broadway from Twenty-eighth Street to Lovelaceville Road; Lovelaceville Road from Broadway to city limits; Blandville Road from Lovelaceville Road to city limits; Park Avenue or Hinkleville Road from city limits to Thompson Street; Ninth Street from Tennessee Street to Madison Street; Jefferson Street from Ninth Street to Eighth Street; Eighth Street from Jefferson Street to city limits; Madison Street .from Ninth Street to Eighth Street; The Paducah Belt Line; Trimble Street, or Park Avenue, from Fifth Street to Eighth Street; Third Street from Norton Street 268 to Broad Street; Meyers Street from Mill Street to Fourth Street Clements Street from Bridge Street to Myers Street; Fourth street from Myers Street to Broad Street; Tennessee Street from Sixth Street to Ninth Street. SECTION 12. Any police officer of the city shall have the right to stop the operator of any motor truck, semi -trailer or trailer in order to make measurements as to the length, width, height or weight of such equipment and load and may require the driver thereof to proceed to a scale to ascertain whether or not such equipment exceeds the maximum limitations prescribed herein. The fee for the use of such scale shall be paid by the operator of such equipment. SECTION 13. The City Manager may, in his discretion, upon application in writing and good cause being shown therefor, issue a "Temporary Special Permit" in writing authorizing the applicant to operate or more a motor vehicle, or combination of vehicles, of a size, weight, length, width or height exceeding the maximums provided for in this ordinance. The appli- cation for such special permit shall state the proposed maximurp wheel loads, maximum axle loads, and minimum axle spacings of such vehicles or combinations thereof, and the height, width, and length of such vehicles with their load, and the specific streets or public ways over which permit for such operation is requested and the time of such operation. Such application shall also state whether the permit is requested for a single trip or for continued operation. The City Manager is authorized, in his discretion, to issue or to refuse to issue such a special permit, to limit the number of trips to be made thereunder, to establish seasonal or other time limitations, to designate routes over which the vehicles described in the permit may operate on the streets or public ways of the city, and may otherwise limit the prescribed conditions of operation of such vehicles when necessary to assure against undue damage to the street foundation by such vehicle, if, in his opinion, such operation may damage the streets or public ways, and may require the applicant to give bond, with sufficient surety to be approved by him, to indemnify the city against any damage which might occur to persons or peoperty by reason of the operation under such special permit. Such "Temporary Special Permit" shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any peace officer, and any pperation or use of vehicles under such "Temporary Special Permit" shall be in strict conformity with the terms thereof. A person operating under a "Temporary Special Permit" shall not be obligated to purchase a license under Section 8 hereof. 269 SECTION 14. The fee charged for each "Temporary Special Permit" shall be w5.00. SECTION 15. The issuance of a license or a "Temporary Special Permit" hereunder shall not be construed to exempt the holder thereof from the obligations of compliance with any and all other applicable ordinances of the city. SECTION 16. If any section of this ordinance, or any provision or exception contained in any section of this ordinance, shall be held to be invalid or unconstitutional, such fact shall not affect the remaining portion of this ordinance, or the remaining portion of any such section, it being the intention of the Board of Commissioners to engct each section of this ordinance, and each provision and exception thereto, separately. SECTION 17. All monies collected under the provisions of this ordi- nance, shall be paid into, and become part of, the General Fund of the city. SECTION 18. Any person who violates any provision ofthis ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not less than Ten Dollars ($10.00) nor more than One Hundred ($100.00). Each day such person violates any provision of this ordinance shall be con- sidered a separate offense. SECTION 19. This ordinance shall take effect and be in force from and after its passage and publication according to law.
