HomeMy WebLinkAboutOrdinances Book 12, Page 228, No Resolution NumberA RESOLUTION DECLARING THE POLICY OF THE CITE OF PADUCAH, KENTUCKY, RELATING TO THE USE OF CITY SEWERS BY PERSONS RESIDING OUTSIDE THE CORPORATE LIMITS. WHEREAS, it has come to the attention of the members of the Board of Comm- issioners that certain persons residing beyond the corporate limits of the City of Paducah have residences which are served by connections with city sewers; and WHEREAS, some of such non-residents have obtained the permission of the Board of Commissioners or the City Engineer for making such sewer connections while others have not, but it appears that none of the residents now being served with city sewer facilities have intentionally or deliberately connected their laterals onto the city sewers with knowledge that they were doing so illegally or without right; and WHEREAS, the illegal sewer connections made by the non-residents of the city may in some measure be the result of the failure of the city of Paducah to have adopted a definite policy with respect to the use of sewers by non-residents and to give all such non-residents adequate notice of its policy; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Board of Commissioners does hereby declare as its policy that no person owning property beyond t',:e city limits shall have the right to connect on to a city sewer, or on to any other sewer now connected with a city owned sewer, and if any person shall hereafter make a sewer connection for servin,c any residence located outside the city of Paducah, such illegal use of the city sewer shall be prevented and if necessary, the city will resort to injunctive relief against such illegal user in order to assure the citizens and taxpayers within the city of their exclusive right to use the city sewer facilities with- out interference and without overloading the sewers on account of their use by non-residents.
