HomeMy WebLinkAboutOrdinances Book 12, Page 19, No Ordinance NumberAN ORDINK14CE APPROVING THE FINAL REPORT OF THE CITY PLA JNING AND ZONING CO?i'.iISSION TO AMEND SECTION 2 OF AN ORDINANCE ENTITLED: "AN ORTDINIAiJCE A:'PROVING THE i� INAL REF ORT OF TIE CITY PLANNING AND ZONING COMMISSION PROVID1.11 ICOR THE Z01II14.1 OF CERTAIN PROPERTY ON L07.'H SIDES OF KENTUCKY AVENUE FROIeI THE ?JEST SIDE OF 19TH STREET TO THE EAST SIDE OF NAHBi AVENUE AS A RESIDENTIAL DISTRICT, AND PRESCRI'�-lldG THE PENALTY TO BE I1JPO3,_`D FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESO- LUTION ADOPTED BY THE CITY PLANNING AND ZONING COI,IMISSION ON JULY 7TH, 194111, AHM AHEINDING SECTION 2 OF SAID ORDINANCE WHICH"NAS ADOPTED BY THE BOARD OF COMMISSIOJTMR ON JULY 8, 1941, AND AIEKTDED ON MAY 20, 1947 WHEREAS, the City Planning and Zoning Commission has recommended the amend- ment of Section 2 of the aforesaid ordinance as shown by its final report embodied in a resolution adopted by it on '.larch 3, 1950; NOW THCREFORE, BE IT ORDAINED BY THE BOARD OF COI:TP.IISSIONERS OF TIS; CITY OF P_9DUCAH, KENTUCKY: SECTION -1. That the aforesaid final report of the City Planning and Zoning Commission be approved, and that Section 2 of an ordinance containing the title quoted above, ,✓hich was adopted by the Board of Commissioners on July 8, 1941, and amended on 31.ay 20, 1947, be and the same is hereby further amended so that said section as amended shall read as follows; "Section 2. In order to further promote the general welfare of people in said district or zone and to enhance the desirability of same, all property within said area is subject to the follwaing restrictions: 1. '!here shall not be erected upon any of the property within said area any dwellin house or apartment costing less than '`9000.00 and such dwelling or dwellings shall be built of good quality commercial material. 110 trailer basement, tent, shack, garage, barn or other outbuilding erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted. 2. No residence building or apartment house shall be i erected nearer than 25 feet from the front lot line, i provided, however, that steps, windows, porticos and other projections appurtenant -to such building may be within the 25 foot limit. All residences shall front upon Kentucky Avenue." SECTION 2. All ordinances and parts of ordinances in conflict herewith, are to the extent of such conflict, hereby repealed. SEC TION 3. If any section or provision of this ordinance shall be found to be inoperative or ineffective for any cause, the invalidity of such section or pro- vision shall not affect any other section or provision of this ordinance, it being the purpose of this ordinance to make each and every section and provision hereof separable from all other sections and provisions.
