That upon the recommendation and request of the City Planning and Zoning Commission as shown by its final report embodied in a resolution adopted by it on November 17, 1950, all of that property bounded on the east by the west line of ;iinth street; on the north by the south line of i:iadison street; on the south by the north line of Irionroe street and on the west by the east line of the property which is presently zoned for business use and which lies east of Tenth street, is hereby declared to be a business district within the weaning of the City Planning and Zoning Commission Law and to be used for business purposes. SECTIO'd 2. All property within said area is subject to the following restrictions: "i4o building pemnit shall be issued by the Building Inspector for use within said boundaries un]e ss and until the design, location and type of said building be submitted to and approved by the City Planning and Zoning Commission." SECTION 3. Any property owner, tenant or other person who erects, construct: or reconstructs any building in violation of or contrary to the aforesaid pro- visions of this ordinance, shall be deemed guilty of a misdemeanor, and upon con- viction thereof shall be fined in any stun not less than $10.00 nor more than :100.00 for each offense so committed and each day such offense is committed shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION 4.
