HomeMy WebLinkAboutOrdinances Book 12, Page 17, No Ordinance NumberAN ORDINANCE PROVIDING FOR THE E1.11PLOYLIENT OF ATTORNEYS TO REPRESENT THE CITY OF PADUCAH, KENTUCKY, IN LEGAL MATTERS; FIXING THE NUMER TO BE EMPLOYFD AND THE AIJOUNT OF THEIR CO:.iPENSATION; AND PRESCRIBING THE DUTIES OF SAID ATTORNEYS. BE IT ORDAINED BY THE BOARD OF COLIMISSIONERS OF TILE CITY OF PADUCAH, KENTUCKY: SEC TION 1. The City of Paducah shall employ three attorneys as representatives in its legal matters, one to be designated as the Corporation Counsel and the other two as Assistants, one assistant to be assigned to the handling of civil matters for the city for a period of ten months and the other to be assigned to the Police Court of said city. All shall be regularly admitted and practicing attorneys at law. They shall perform their duties under the direction and control of the City Manager, and the employment of an attorney in any of said positions may be terminated by the City P,anager any time. SEC TION 2. The Corporation Counsel, assisted by the Assistant Corporation Counsel assigned to the handlinS of civil matters, shall, as the occasion may require, represent the city in all cases in the Circuit Court, the Court of Appeals of Kentucky, and the Federal Courts wherein the City of Paducah may be a party complainant or a defendant, or a party in interest. The Corporation Counsel shall have the responsibility of giving advices to the City "anagen, the members of the Board of Commissioners, the City Treasurer, the City Engineer, the Street Superintendent, and all other officials of the city excepting those specifically designated in Section 3 hereof. Provided, however, in the absence of the Assistant Corporation Counsel assigned to the handling of Civil matters, or when he is not available, the Corporation Counsel shall perform all of the duties imposed upon said assistant. Vie Corporation Counsel, or said assistant, in the event of the former's absence from the city or his inability to perform his duties, shall attend all � meetings of the Board of Commissioners unless his exclusion therefrom is requested by the City iaanager or any member of said board, and shall supervise and prepare all contracts to which the city may be a party. The salary of the Corporation Counsel for his services shall be ;285.00 per month and shall be paid at the same time and in the same manner as the salarie of other employees of the city are paid. SEC TION 3. The Assistant Corporation Counsel assigned to the handlin of civil matters shall assist the Corporation Counsel in all liti;ation involvin- the acquisition of the electric utilities system of the Kentucky Utilities Company, as well as in other liti3ation where the Corporation Counsel may require assistance. Iie shall also have the responsibility of giving advices to the Building Inspector; the Chief of the Fire Department; the Chief of the Police Departriont; the official of the City Planning and Gonln-g Commission; the lloard of Adjustmont, The Police J l6'19S/ /z -ev—1 2�Z 18 and Fireman's Pension P7znd, and the Appointive 'lnployees Pension ,'und. in the even of the absence o.f the Corporation Counsel from the city, or -;hon he is nog availabl , said assistant shall perform all of the duties imposed upon the Corporation Course Paid Assistant Corporation Counsol shall receive a salary of ;,200.00 per month for his services, same to be paid at the same time and in the same manner as the salaries of other employees of the city are paid. SECTIO'rT 4. lite Assistant Corporation Counsel assigned to the Police Count of the City of Paducah shall appear for the city in all cases in the Police Court, and shall prosecute or defend on behalf of tho city all appeals froi:i the decisions of said court, in which the city may be a party, or is in any xray interested. Said Assistant Corporation Counsel shall receive a salary of ;;135.G0 per month for his services, the same to be paid at the same time and in the sar:e manner as the salaries of other employees of the city are paid. SECTIOIT 5. rhe City :Tanager is authorized to provido such clerical assist- ance in the performance of the duties of said attorneys as may be .found necessary for the efficient handling of legal matters for the city.
