AN ORDINANCE APPROVING AND RETII''YING A DECREASE OF TiIIRTY PERCENT IN
THE MONT7ILY CHARGES MADE TO 'FHE CITY OF P- DUCAH FOR FIRE PROTECTION PURSUA !T TO
THE RECO10,19'1DATION OF THE COM1V7t1..S10i:SRS OF 'NATER WORKS OF PADUCAH, KENTUCKY;
FIXING THE EFFECTIVE DATE OF THE DECREASE IN UIE CHARGES FOR STATER SERVICE; AND
PRESCRIBING THE CONDITIONS UPOW WHICH THE CHARGES FOR PLATER SERVICE SHALL BECOME
EFFEC TIVE;
2-HEREAS, the Commissioners of uVater '.'."orks of Paducah, -Kentucky have
filed .ith the Eoard of Commissioners a certified copy of a resolution reciting:
"that the bill for Fire Protection Service paid by the City of Paducah
to the Paducah Slater Works which is for fire protection of all the inhabitants
of the City of Paducah, the charges for which are based upon the per lineal foot
as it relates to the diameter of said pipe plus a fixed yearly charge based upon
the number of fire hydrants, can, by reason of the rate increase which became
effective with the January 1950 billing be reduced without impairing the hater
1.7orks Bond and Interest Redemption ,lccount or the Operation and Maintenance and
Depreciation Accounts. Therefore, the said Commissioners of ,+pater 7;orks of Paducah
Kentucky recommend to the Board of Commissioners of the City of Paducah, the
legislative body thereof, that said Board of Commissioners approve and ratify a
decrease in said bill in an amount equal to 3C% of each monthly charge, said
decrease to become effective November 1, 1950, conditioned, however, as follows:
"The rate increase above referred to is now being contested and a suit
thereon is pending before the Court of Appeals of Kentucky. The above recommen-
dations are, therefore, contingent upon the final approval of said rate increase
by a Court of last resort or in the event the question is submitted to a vote, an
acceptance of said rate increase by the voters of the City of Paducah. the amount
of decrease in such billing will be set aside in a separate fund to be held by the
Commissioners of :nater Works until the rate increase is finally settled in favor
of its validity and in the event such rate increase is either held to be invalid
or voted upon negatively b;: the voters then in that event the fund so set aside
shall be placed with the general funds of the Paducah ti',ater 1lorks."
NOW, T±MREFORE, BE IT ORDA"iNED BY THE BOARD OF CMiilIISSIONERS OF THE CITY
OF PADUCAH, KENTUCMZ:
SECTION 1. That the City of Paducah approve and ratify the decrease of
thirty percent (30%) in the rate charged said City for fire protection service,
the decrease in said rate to become effective as of November 1, 1950, as recommende
by the Commissioners of Plater Vlcrks of the City of Paducah, Kentucky, but subject
to the conditions that said rate increase jhall be approved by a Court of last
resort or in the event the question is submitted to a vote of the people under a
judgmont or order of the Court of Appeals of Ientucky in a suit now pendia,- in

that Court, there is an acceptance of said rate increaso by the voters of said
c ity.
SECTION 2. That the City of Paducah further approve the action of the
Commissioners of ,tater 'forks in setting aside the amount of such decrease in a
separate fund to be held by the Commissioners of ;later ',;`orks until a decision
is rendered on the above appeal, and in the event such rate increase is either
held to be invalid or voted upon negatively by the voters, then in that event
the funds so set aside shall be placed in the general fund of the 'Paducah .ater
':forks.
SECTION 3. This ordinance shall be in full force and effect on and
after november 1, 1950.
